Advice on a Murder Charge

Does your friend have any self defense wounds? That would help make a case - if he doesn't have any cuts/bruises/etc. then he is f**ked.

This won't get a murder charge. That requires not just intent, but premeditation. There is no way he could have planned for them to find him walking along the street, and planned to cut the guys throat via a broken bottle. Maybe, MAYBE they could go for 2nd degree, but doubt it.

Self-defense laws don't allow the use of force that is greater than the threat - i.e., if he comes at you with a knife, you can stab him. If he was coming at him to beat him up, you can't do anything but fight him back. Of course, this isn't if he breaks into your house or something, then all bets are off. That said, if Corpsey had a knife on him, your friend might get self-defense, but doesn't sound like he did.

So, the most logical result of this is a voluntary manslaughter charge. This is the intentional killing of a human being by the unreasonable but honest belief that it's justified. I'd expect that's what will happen. He's going away for a long time, but probably nothing close to life. Depending on the state, Man 1 carries a sentence of 5-20 years or so.

It's possible, but not likely, that he could get involuntary manslaughter; aka, the unintentional killing of a person by being reckless. He was trying to scare him off but not trying to kill him. Based on what you've told us, this is the most legitimate charge, cause he wasn't trying to kill the guy. However, hard to prove. If somehow they pull this off by a plea bargain or whatever, it's something like 3-15 years or so.

Maybe you can send him some Anal-eze baked into a cake.

He actually had the charges dropped down to involuntary manslaughter this morning, I am not sure what happened or why, but...........

What else do you want me to say. Hes was a friend of mine awhile back, and I hate to see things happen like this. Hes 21 and has a whole life ahead of him, and a daughter to care for. he WILL go to prison for what he did, its just a matter of how long he will spend there.

Yes, he got Battery on a Leo, do you know why, no you do not and neither do I, but even so, it doesnt make him a bad person. What he done was uncalled for yes. Intentional, from what I HEAR no. He will have to pay for his mistake now.

Do I believe he deserves life in prison for it, NO i do not. If the guys would have kept thier azzes at the party, the one guy would be alive. They should have just let him leave as he did, and be done with it but no.................

I dont know the whole story yet, but apparently the other guys are in trouble for something as well. others at the party stepped up and said something (not sure what) and things are looking better. he will go to prison, but not for life now. He's a wreck right now from what i understand. Only family are allowed to visit, so................ we used to hang 2-3 yrs ago, and yes, he turned towards weed and drinking, but he still is a good kid.

he is having to learn the hard way as some do, but he will hopefully be a better person now after this is all over with.

Well, maybe the guys followed him, but they presented no threat of physical violence at the time of the murder. Had your friend had hands laid on him or at least a violent gesture then that would be means for self defense. The fact of the matter is, if that would have happend then your friend would have little time to smash a beer bottle and slash the guys throat had he been intent on harming him.
