Advice on a Murder Charge

Not asking for advice on what to do, just wanting opinions. What does the ppl here think he should get? yes, he did kill someone, but if 3 guys where trying to start a fight with you and you left, then a few minutes later they came pulling up next to you while you were walking down a dark country road, what would you do? He defended himself IMO. I'd of prob. done the same **** thing if I was him. Gotta do what you gatta do. He didnt mean to kill him, but it happened. he just wanted to hurt him so the others would haul *** as well as this guy.

Doing a hypothetical question is nice...but its up to potential jurors to make this decision or a prosecutor in plea negotiations. This is a serious matter, any murder charge is a serious one, and the ONLY option is to hire the BEST criminal defense attorney you can afford immediately. This is a life changing event and being cheap will literally ruin this guys entire life if he lets a PD take the case.

what the hell do you think is going to happen when you stab someone in the neck with a broken bottle? gotta do what ya gotta do? shoulda threw up the hands. Obviously the other guy wasnt much of a threat considering he allowed himself to get stabbed in the friggin neck.

i understand were you all are coming from here. I know David doesnt have the cash for a good lawyer, but hopefully things will turn in his favor or something. maybe the others will talk and slip up of something.

It wasn't self defense, he had the weapon. self defense would of come into play had he used his fists and this guy cracked his skull open on the sidewalk by accident.

I wouldn't see why the charges couldn't be reduced to manslaughter since I doubt your friend had intentions of killing someone that night. The fact that he used a broken bottle and not a knife could help to prove that.

It's not just that county. It's everywhere. If he admitted to the crime, there's not much he can do other than work with a public defender. Even then, the most that will happen is a lighter charge. Most likely Voluntary Manslaughter since (from what I understand) he had the intent to cause serious injury even if he didn't plan to take his life. In some (not all) states they can drop the charge even further to "Voluntary Manslaughter by Imperfect Self-Defense". Though if the charge were allowed in the state in which the crime occured, if the victim was completely un-armed it would be rather hard to consider this.

na, Davids a white boy. All of them are white boys. This one redneck *** town though and David is known by the law around here for drugs. They already dont like HIM much. Dont know much about the other guys

Your friend killed a guy. He wasn't in danger of great bodily harm or death. It sounds like he was a real winner anyways with the drug stuff.

I'd say he deserves what he gets.

how do YOU or ANYONE, INCLUDING ME, for that matter know he wasn't in true danger as there were 3 of them and only him? the other guys could of had weapons, but they arent going to tell the police this, now r they?
