Advice on a Murder Charge

hahah i couldnt figure out what was going on. at first i thought your buddy was the one that jumped out the truck and tried to **** up the guy that was walking. and for that i was gonna post, tough shit, your buddy deserves to go to hell.

then i realized your buddy was the dude that was walking down the street while they went to start shit with him. unfortunatly he got a little over his head, when he went for the dudes throat. kinda shitty, but no doubt he was startled, and from that point it was "fight or flight".

dont know what to tell you, but i saw a good lawyer is a must.

I know what u mean here. I hate it that he will have to go through this, but he did this, and he will have to deal with this the rest of his life reguardless of the outcome. it will take a long time for this to get over with here.

some have to learn the hard way .

not true at all..this is why i made my 1st post...admission means almost nothing in this stage.
If he states to an interrogator that he had intended to take this mans life and they have it on record, you think the Judge, Jury or D.A. is going to give him a break? Of course he can admit to killing this person and still stand a chance at a lesser charge, but I can't see this happening if he's already said "I planned to kill him". Without a private attourney, that's almost a guaranteed Murder conviction.

Federal rules of evidence might apply...nobody knows the specific circumstance. Our constitution and the FRE have exclusions when introducing evidence. You cant just volunteer "Hey I killed him and I enjoyed it" and expect it to walk into court if it violates any rules of collecting evidence. Self incrimination is protected by our 5th amendment...

 
he stated he did it, but didnt know the guy was dead. The guy junped out the car and rushed towards him. he busted the bottle on the road and when the guy got to him, he tried to get him with the bottle before the other 2 got out of the car. he done what he did and the other guys ran back to the car and he ran away as well.

I'm assuming, the other guys didnt know he was dead either until a little while later and then called 911.

No one knows exactly what went on except David and those 3 guys, and one of them cannot tell anyone anything, and the other 2 are not going to confess to doing any wrong doings.

from his sisters story, he was going to stab the guy in the hand when he tried to punch him, but he never punched he just ran and rushed him. The typical redneck thing around here. Tackle fighting!

Yep. I'm tellin you he needs a good lawyer, spending 20k could save him from spending an extra 5-10 years in prison, which would mean a loss of at least $100k in potential earnings if he was in prison making Gators license plates.
