Should i sue them or not?

i actually called my sisters husband who is a so-called "protection" lawyer for ford motor company, he specializes in protecting the company from civil suits. He said that this is one of those cases that he would advise ford to pay to make go away.
You need to get yourself an attorney and make sure it is one of those free consultation ones like snova said. Then you can decide wheather or not you want to take it too the next step. I say do it for sure, being your son was in the hospital. Make sure you keep all your records and tell them that at the attorneys.

You are under grounds to sue. You are protected by the Americans with Disabilities Act due to your son's illness. Since the law was put into effect to ban smoking, you have every right to be accomodated. Go for it.

 
I agree that you should bring litigation against them, and be sure to get your hospital/medical bills reimbursed. The Buffalo Wild Wings here in Michigan (as all other businesses are) is trying to institute the smoking-in-public ban. I am a smoker, but i have no problem not smoking in a public place. We have restaurants here now that have no smoking anywhere in the building, and it has never caused a problem with me or the people i am usually with. Good luck with the law suit, and give 'em hell!

I don't think you have enough to get any sort of big settlement, but like I said, you should at the very least be reimbursed your expenses.
Yea, he could. His son went to the hospital because of it. He called corperate office of BW3's and they even said they were in the wrong and they should have that recorded as well. So he should be able to retrive that. So I think he has a good case and could get some money out of it.

Sue them...not for the money.....just for the satisfaction that those ******* will most likely lose their franchise liscence and have to rethink their ways of running a business

He can probably get something, but not anything huge is what I was saying.

I was rear-ended at a red light, and the person took off. We eventually found them. I went to the hospital twice, and have just been cleared to return to work, after 4 months of physical therapy. I also lost my job because of it.

We are taking their insurance company to court. But, the most I'm going to get is $50,000, minus attorney fees.

Different situation, but just saying that I don't think there's that much to get

 
I personally feel that the individuals involved are at fault, not the corporation. (**** corporations though) If smoking in public is agianst the law, shouldnt the police have been called to straighten out the teenagers AND the establishment?

 
I don't really see how you have an actual lawsuit because someone decided to smoke in a public place that you walked into willingly. Coulden't you have moved to another table on the other side? I don't smoke but are around it quite often, it's something that you have to deal with sometimes and avoid it if you don't like it.

 
I just wanted to say this as well....this isn't about me, a non-smoker, taking on the smokers. That is your right if you choose. This is about me making corporate america live up to their responsibilities to follow local, state, and federal laws that were put in place to protect not only the patrons but the company that must follow them as well. If they were principal based in their decision making process, this never would have been an issue, but what it boils down to is that until someone holds them accountable, they will simply disobey public laws because it might make them a little more money.
