Oki, first let me say that i do not agree with the government's ability to tell an individual that they can't smoke if they so choose to do so. However, i do agree with the government's right to tell smokers that they cannot trespass their smoke upon my children and my lungs. With that being said, i whole-heartedly support the State of Ohio public smoking ban.
Now to the specifics. Last night, i took my children and wife to BW3's for dinner, and i noticed on the way in that they now have "No Smoking on the property" signs posted everywhere since Ohio recently passed the public smoking ban. After sitting there for 20 minutes while waiting on our food, a group of 4 teenagers walked in and sat at the table next to us and proceeded to light up some phillys. They then asked the server for an ashtray and her reply was "this is a no smoking establishment", then she proceeded to get them an ashtray. I asked them to put them out, as my oldest child has a nasty case of asthma, which as expected i got a fluid stream of obsenities out of the head wigger in charge.
This is where the behavior of the employees becomes relevent. I called for the server to come and tell them to put out the cigars but she said that since Ohio has yet to issue any fines, that they were not going to enforce the ban in BW3's. So i proceeded to call a manager to remedy the situation and much to my suprize, she also said that she would not do anything about it. I just so happens that i had my laptop in my car, so i called up the webpage on the ohio revised code where it outlines what the law is. Turns out that i was right and the ban is in full effect, and even after i pointed this out to her, she asked me and my family to leave since i was causing a "scene" as she put it. So after getting her name and the phone number of her store manager, i of course left halfway thru our meal, which we did not pay for. The kicker is that 1 hour after we get home, my son has a full blown asthma attack and we end up in the emergency room at 2 in the morning.This morning i called her store manager and her said that he supported his manager in her decision.
So i called BW3 customer service line and after 30 minutes got ahold of someone who is in their legal department and his comments were that the franchise was completely wrong and that he would handle the situation and that he was gonna send me some coupons for free food. My response was that why would i want to eat someplace that will allow its patrons to poison my son's lungs and he replied the coupons were also good for takeout.
So now i'm thinking about bringing litagation against them for the way my family and i were treated. So, do you think i have the right to be upset and consider legal action against them?
