Ill try to keep it short. Room mate orders pizza a few Sunday's back. He says they keep putting him on hold so he wasn't getting pizza anymore. Night goes on with about 8 people over just playing rummy, drinking a few brews, and watching 8 mile. Get a knock on the door and the roomy tells em to come in. We figure it is just a neighbor coming to hang. Well turns out it is a police officer. He comes in telling the roomy to not let everyone in if there are bongs, pot, and beers out when no one is 21 years old. He asks about the stolen credit card used to try to order pizza. Roomy explains that it's his parents and he must of read off the number wrong because the name on the card that was reported was different than his mother's name. The cop takes the few tenths of a gram of pot and the bong. He writes us citations for the pot (simple possession), but not for the beer and does not take us to jail.
My options with this citation:
PTI: $100 application, $50 drug program, $255 acceptance fee, $30 drug screen(s), $285 expungement fee + any other stupid programs, counseling, and mad community service they want to make me take. Total = $720 + gas and any other additions that I don't know about.
Fine : Max drug fine $580. Lose license for 6 months
Conditional Discharge: Random drug screens @ $30 a piece, $285 expungement fee.
The judge in Clemson will not allow conditional discharge. He gives max drug penalties. I have spoken with the lieutenant and he is very helpful and nice. Takes the time to call me after reading emails to further discuss my questions. I just hate how someone came into my place when we were not disturbing anyone, found the tiny amount of pot, and now I have to pay lots of money and spend the next year in this stupid program, or I can pay lots of money, not be able to drive, and not be able to intern where I want to over the summer.
I have been fucked over because I was watching a movie and playing cards with some friends is how I feel. Yes, the drug is illegal and the roomy should have checked further into the pizza situation and not allowed the cop in, but I mean come on.
They don't want to better the community with community service and things like that. They don't want to punish me. They want to rob me and not allow me to make back that money by not allowing me to drive nor get a good job. I really do not understand why it works this way.
I do appreciate the option of PTI, but if conditional discharge is out there, cheaper, and not as big of a hassle as PTI, why will the judge not allow me into the program? Not only is the license things a big deal in general, but my brother just passed away the weekend before this charge and if I get my license suspended, I have no way of going to visit her when she needs her only son. The penalties for possessing such a tiny amount of a drug less harmful than alcohol are nothing but inconsiderate and mean. **** You Judge.
