Should I sue?

Nothing was broken and I didn't notice anything missing. Getting a month's rent out of those money hungry *****es is not going to happen. They are penny pinchers. I might be leaving early, before the 30 day notice is up though. I don't know. I do have a $750 deposit that I'd like back but the chances are pretty slim as far as that goes. Knowing them, they'll make up some shit. I'm not currently on a lease, thank God.

PS. How come all these 19 year olds in my thread don't seem to have a brain?

Are there other units above/next to yours? They may also have had a blockage and called maintenance. The plumber may have determined it was clogged in your unit from all the taco grease down your drain, Thus making entry into your unit without permission fall into the emergancy type catagory, being as it was effecting others in the "hood". Get over it. Buy a house and a gun then you can controll who enters your house.

Ha! My landlord got no money. He won't be able to afford to live if he lost his job at Walmart and he's in his 60's. If anything, I won't see any money out of this. I just want to let them know that it's not right to just enter other's property as they please. That's the law.

Are you saying that if you had a $750 deposit, you wouldn't try to get it back? If not, I call BS on it. You don't know the power of the dollar until you try to make it on your own.

EDZY, there are no other units here. It's a 2 unit townhome. I live in one and the landloard lives in the other. This thread is just really for opinions. Looks like you guys wouldn't sue.

Are you talking about your security deposit? Unless you messed up the house you're gonig to get it back. You're not really being clear on what exactly you want from this? What exactly do you want to sue him for? Him coming into your house without your permission gives you the right to move out if you want. And as long as you didn't mess the place up you're going to get your security deposit back. I don't get what the issue is?

 
I'm 18 and I can tell you that if you even try to sue, even if you dont win, your a dick. or you just have a really small one... just my 2 cents.

That is the sum of it I have done plenty of construction work on residential rental homes and unless you are buying it or own it the property owner has the right to let anyone they want in to maintain the property you have to figure it's an investment they have to protect. If they just went away and let anyone live there with no background check and never stopped by to inspect the property it would go to hell in a minute, and the repair cost would be through the roof. Bottom line you can't sue that's why the lawyer has not called you back!

For one, it's about respecting my privacy. Just because you're the landloard doesn't mean you can enter the property at any time you want. That's why there are laws that protects us as renters. What I want from this is to teach them a lesson; you can't just go barging into people's shit without permission. I don't think you guys are aware that my rights as a tenant has been violated because I wasn't notified, in any way, that they were entering my unit.

Secondly, I do understand that it is his property. Does he own it? Yes, but once you decide to rent/lease it out to other parties, you have to have permission to enter the property:

My sink being clogged is not an emergency. It could have been taken care of when I came home.

And last, Tonka, I bet you got a smaller dick. I don't think some 18 year old who don't know shit about renting should even respond in this thread. I would bet up on it that you still live at home with your mom eating off her income.

 
I see wher you are coming from on this osl, but I have to agree with everyone else that suing will get you no where. I would talk to the landlord first if I were you.

Getting your deposit back shouldn't be hard as stated earlier as long as you haven't trashed the place. When I was renting the terms specifically stated that when I moved out I had to have the carpets professionally cleaned. But instead of wasting my money I borrowed my mother-in-laws carpet cleaner and made that apartment my b!tch. It was so much cleaner than when I moved in. Landlord was so excited, she was happy to give me everything back.

So there ya go, that's my 2 cents. Do what you will with it.

 
I completely agree they violated your privacy. Id be pissed too. But suing is not an option. Even your legal options dont really involve monetary compensation.

Photograph, or better yet video record, the condition of the unit when you move out. Get pics/video of the stone still working, the appliances still working, the faucets, etc. Document as many details about the condition of the apartment as you can. If they try to keep your security deposit by making up stories, this evidence will be invaluable to your case. In fact, usually just letting a shady landlord know you have (or will be) video taping the condition of the unit is enough to scare them into giving you back your deposit (if no evidence really occurred). And dont let them charge you for replacing carpet or painting the walls, assuming you've been there 12 months or longer. They can charge you to clean them, but not to replace. Its called 'normal wear and tear', which is another tip to a landlord, if their tenant says it, that tells the landlord the tenant is ready and able to dispute and unlawful charges upon leaving the property.
