Just how exactly is your moms shop connected to all these other stores. If they are all connected to together and someone owns the whole complex, then I think the owner of the shopping Complex would be at fault. Im no lawyer though.

If its the door, its not the business owners fault. You dont install the door....

i asked my mom and she says all the shops on the block are owned by one owner.. so basically theyre going to be suing him right? its not my moms responsibility to follow up with building guidelines is it? she rents that store out and runs business from it but shes not responsible for meeting guidelines is she?

The counter at the pizza place that i work at is like 4ft tall, most people have a hard time looking over it. If he didnt go in to the business and purchase anything he is just being a b!tch. I would smack him upside the head.

thats exactly my train of thought.. i asked my mom if a man in a wheelchair ever even had any alterations done on anything.. she said she doesnt think so but there are 3 of my aunts that work with her, and they mightve done work for him while my mom was gone or something.. but if we're certain he never purchased anything from the shop, r we pardoned?

good point.. in fact, id like to see him bring receipts from all the business places he's suing. hes literally suing everybody in that shopping center.. doesnt he have to go to court and say he was shopping at each of them? wont the judge realize hes a greedy bastard whos just trying to sue as many ppl as he can?

My first impression is that this guy is a serial sue-er. Try and find out if hes ever filed claims like this before and then file a counter suit saying hes abusing the system or something like that. I hate those douchebag mother ****ers that abuse the system because they got ****ed over in life and are in wheelchairs...

This guy is probobally going to try any win money from you by bringing up the Americans with Disabilities Act passed by Congress in 1990. More than likely, he won't win anything if he's simply complaining that the counters are too high or the door is somewhat hard to open. If anything, the state will order you to fix any problems that are not up to standards, which aren't particularly high in the first place.

If your mom rents, she is not liable. Owner of strip mall is. He doesn't have to purchase anything to bust you. If the business doesn't have handicap parking or ramp, BUSTED. ALWAYS, and I mean ALWAYS put employee only bathroom. $hit like this will happen all the time. Some guys think their life is over, so tries to ruin everyone else's. Nothing to worry about in your moms case though. I'll be her lawyer if needed. actually, it's funny that u mention that. a couple months back, my dad painted a handicap parking spot for our smog shop because a lot of auto repait places down the street were being sued for not having handicap parking.. someone was going around and looking for shops with no handicap parking; im not sure if it was the city or a signle individual.. we heard these shops were being fined about 25,000 dolllars (or got sued for?) each shop so my dad went and painted an ugly handicap parking spot that met guidelines. my dad says he thinks the same lawyer that was working those cases told some other ppl to go around looking for other shops to sue..
