Smoking cigs isn't illegal nor does it affect your judgement or motor skills like pot. If it was his break time then having a cigarette outside isn't the same or near the same as reefer on the property. Now I have fired those skating into the bathroom for cigs when they should be on the floor.

ya he was on the clock. he could have easilyy takin his break and just drove around the block or even down the driveway slow and come back. i might have noticed or smelled it but its harder to prove. if i can prove he ****ed something up and think hes on drugs i can have him sent for urine test. but i would not have wasted my time honestly

lol uh oh ... i have never smoked on the job although i will go to my hotel room on break and blaze ... ( i usually work out of town and stay in hotels ) but to smoke ON the job site is just stupid!!!

That is your right, but obviously it is accepted behavior in his establishment.

Some places you can still smoke inside...my dad's job, for instance, still allows indoor smoking.

Speedbump3, how does it become your liability? You mean to try and say that if someone is smoking pot in say... a school its the school's liability? I fail to see your logic.

As manager of a facility it is my job to know what my employees do on the clock. If they hurt someone because their attention span was altered by their on site drug use, I am liable. How you can't understand that is beyond me.

I give second chances on a lot of things, except drug or alcohol use on premise during work. It is absurd and proven many times that it isn't worth the second chance. The second time could be him injuring himself or another while high.
