should unemployment be granted?

well a week or so ago my girlfriend got laid off. or so it sounds like. she filed for unemployment, and just today we get a letter sayig she being question that she ws fired.

she was a nanny of 3 kids, worked 11-12 hours a day with no overtime at 11 an hour. the boss a telling her all the neighbors loved her, te family did, that she was bonding well.

well last Wednesday he comes in at noon and says in the last 4 hours alot of things have come to light, that she plays music too loud while driving through the neighborhood, even though its always DVDs for the kids. and he has a 2009 mustang GT that he got new exhaust on and peels out ALL the time.

also that she sent the kid to his room all the time, even though he has behavorial problems, and the parents said they didnt mind her disciplining the kids.

now the boss is saying he fired her, not laid off. a friend of mines neighbor had the same thing, got denied and appealed it. she got the free lawyer made an arguement and was granted it. what might be the outcome of our case?

If people are complaining that you are playing music too loud regardless of whether it is a dvd or not, it's too fing loud.

People are VERY sensetive to punishing their children. Punishing, and discpline are not the same thing.

they said she got fired because as an employer you are required to pay unemployment insurance, so if she was incompatent and got fired its cheaper than if she is unemployment which cause their unemployment insurance to go up. Usaully the employer cant prove it and she will get unemployment, just tell her to dispute it.

it is clear that likely she was being paid under the table and now that she is filing a claim the employeer is trying to cover his *** as he did not have her properly registered as an employee and he has liability in the situation. Sounds like a dick move to me.

ok to clear things up, she wasn playing anything loud at all, the dad always peels out, my keyboard is a little messed up. and my gfs not rude, she was completely taken advantage of.

she paid taxes. the employers paid taxes, i forgot to mention that.

Whos is he? You don't say who people are in your story so we don't know who he is. If I have 3 brothers and mention them all in the same paragraph as he nobody knows what brother I'm talking about. Either she got fired, or they just said she was incompetent and needed to be fired. Either way she isn't getting unemployment.

the boss you wouldnt understand because hes one of the people you have to see to believe how ignorant they are. without a valid reason and no outlining contract of the rules, im sure she should be ok.
