help- someone is trying to sue me

Shoot in jersey thats still insurance points against you. But hey jersey is jersey. F-ed up laws. Anyways. I think in NJ and DE. I know for sure in DE its the same laws. If he is not wearing a seat belt its his fault and is ticketed for not having it on and you get nothing. Also you said he was moving it fine and all. Do you have anyone else that can say the same. If so start getting statements from them.

At this point its not worth it for him to sue you. Are you rich make lots and lots of money. If not I wouldnt worry about it. Most of the time a judge would not side with him. I say that because I had some one try to sue me in the past. Problem was they waited to the last month to do it. In NJ and I think DE you have three years to sue some one for an accident. They waited to the very last month. And then was saying all kinds of stuff about how they couldnt do this and that. *** too. Whatever you can think of. Didnt work for them at all. Court seen right through there crap. And plus I had pictures and quotes from other ppl watching the dude playing basketball and skipping out of classes. Also he was in my car as well. And did not have a seat belt on as well.

Keep in mind too that if you're on your parent's insurance policy this could very well be pursued against them as well.

ok so basically his dad didnt know the laws changed and each occupant is responsible, now that he knows that, he knows he doesnt have a case. So point being I think it will blow over. And I know my fukn friend is fine because he didnt want to go with it at all, thats why he told me his dad was doing this before hand.

I just wanted to get my mind straight on here before anything happened. And he isnt into caraudio FYI anyway

get a lawyer, its alot cheaper to have someone on your side who knows their ish than to jump in the failboat by yourself and try to get it straightened out. the failboat (you) will sustain alot more damage than your 'friends' elbow if you dont get an intelligent person on this.

well, i cant help then because thats totally different from WA law. If a passenger doesnt have a seatbelt on, the driver gets the ticket.

That's only true (in WA) if the passenger is a minor.

Be prepared for him to file a civil suit against you also, he is probably making a big deal out of it because that is going to be the end result. Going to therapy helps your end judgment swell.

I'm not sure why you're so worried though your insurance should be handling all this shit.

yes his is the passenger in my car. In SC they have a new law where passengers are responsible for their own seatbelts. Meaning if i had mine on and his wasnt ...i wouldnt of gotten a seatbelt fine and only he would have.

I don't know the laws of your state but from the way you are describing it, this seat belt law only pertains to fines. The law (from what you have stated) does not take away any responsibility you have for injuries to occupants in your vehicle during an accident.

In any case, you need to setup either a consult with your insurance company or an attorney, otherwise we all are just taking a stab in the dark on the issue and it means squat.

as for this guy coming to you about sueing, like that dude said, its probably because his insurance isnt paying for the damages. As long as your state law DOES say that the passenger is responsible for his own seatbelt, and he wasnt wearing it, then its his own fault IF the damage his body recieved was because of not wearing a seatbelt.

if he can prove his arm would have been messed up regardless of the seatbelt, then i'de be worried

Depends on the wording in this law. The OP has not made any specific detail about the law regarding injuries during an accident only fines. Unless this law specifically states this, I would think he is still responsible for all injuries that occurred in his vehicle.
