1) Do you not understand the concept of purchasing a United States patent at the bankruptcy auction? The intellectual property (Ornamental appearance patent) is no longer property of anybody but Fi, it does not belong to Thilo any longer. It was originally designed and patented by Thilo for Eclipse, but after the QC issues they left TC sounds for an oriental build house. Thilo, still had the intellectual property (Known as an ornamental appearance patent) cornering the United States market. Which a patent is worthless, if you do not enforce it. Which is why you see so many people using it now..because it was not enforced, as it takes money to enforce it. Again this is for a 6 spoke appearance, they can use the 4 spoke (Which is the 10" and 12" appearance) all day every day as Thilo still owns that patent and could care less about it.

2) TC doesn't own the spider adapter, because we tooled one of our own. The spiders that are available on the market will not do what we want to do, so we tooled those as well...which is really funny how you have "seen" everything because what you think you may have seen..really is not what it is.

3) You held the original prototype in your hand, that was nearly a year ago. It is sitting in the corner of the office where it has been for months. You have not seen, held, smelled, touched, or licked the real SMD, much less the new motor technology that we have developed.

As I said, you know..nothing.

Anything that appears to look like that as it is an appearance patent can not be used without an agreement being reached between the patent holder and the party that wants to license it, physical size and dimensions do not matter. It can not look like this appearance patent. It can be from 1/2" in diameter..to 54 feet in diameter, or even a logo tooled into the frame. It only has to be "Substantially similar" in order to be seen as infringing upon the patent. That 'Design Patent' was previously owned by Thilo, and was sold at his bankruptcy auction of TC Sounds.

Now, the following designs Thilo still owns, and purchased back at his own bankruptcy auction. These are his babies, we have nothing to do with these at all, anybody can use these at their own risk of being sued by Thilo for infringing on his design patents that he still owns.

There are so many things involved in something like this.... and so many people talking about "facts" which are actually "heresay". I haven't laughed in anyones face, but in fact have tried to respectfully discuss these things directly with those involved.

We respect all parties involved with this particular appearance patent, have tried to contact and be open about all intentions with all parties involved with this appearance patent. We have heard absolutely nothing back from anyone.

Hence, we will continue to exercise our rights by selling a product that we have branded a company on for 4 years now and were allowed to use by the patents creator and tooling owner (Same guy) where the baskets are actually manufactured.....and that we have tooled other products to fit this product in question.

If anyone has issue, we can be reached by phone, email, fax and by mail.

All which are easily found on the internet, yellow pages, etc.

We are also very prepared to protect the 4 years of hard work that we have put into this company and our products.
