Im no patent lawyer, but I think if/when Fi won the lawsuit they would also recoup any legal expenses created in pursuing their case. Again, T3 should really be asking nicely, and offering compensation, rather than trying to play tough. But it seems T3 just isn't capable of acting in a professional manner.

Never really liked T3. I wish that company would go under. Not just because of things seen here but my personal situations.
