First T3 TSS 18 ever ......

I was under the impression that T3 OWNS the copyright to that "ti" basket?
Last I knew, Fi purchased/owns that basket design in all sizes except 18"
Everybody thinks they (Fi T3 Eclipse etc..) own the patent:rolleyes: and the first MFG's still own part of it.
Why do you think the SMD moofer is taking so long to hit the market?

Fi wants it all to themselves and thats not going to happen. T3 will still make some of the best woofers on the planet with that basket. Not to mention TC will be bringing back their stuff.
If Fi doesn't own it, who does? Its been made public a while back that Fi bought the rights to all but the 18 (again iirc). If Fi purchased the patents, they should 'have it all to themselves' whether or not it upsets Eclipse, TC/AP or T3 fans. This would not limit other company's ability to purchased black market copies of the frames to use, but it would limit where they could sell them, legally.

This was brought to my attention, so i'll reply once, and only once. Merely because this is what it is and nothing short of the truth.

Fi owns the ornamental frame patent which is defined by this. "A US design patent covers the ornamental design for an object having practical utility. An object with a design that is substantially similar to the design claimed in a design patent cannot be made, used, copied or imported into the United States. The copy does not have to be exact for the patent to be infringed. It only has to be substantially similar. [1]."

Note that it does not say what size anything has to be, could make a 1.5" diameter 6 spoke frame that looks like that. Or a 54 feet in diameter frame that looks like that, and it is still all covered under the design patent, an appearance patent has NOTHING to do with physical size or dimensions, rather..appearance and only appearance. After that one could modify it but it only has to be considered "Substantially Similar", so even if it looks close it would still be considered infringing upon intellectual property.

Second of all you do not know anything about the SMD. Nothing. Nobody does outside of the few (two people) that are working on it. It has taken longer then we originally expected because we totally redid the suspension because all of the 10x4" spiders on the market are not up to par, along with adapter rings, and brand new motor technology that nobody has ever seen before.

Contrary to what you may think, hear, or say otherwise, Fi owns the patent and so long as anybody is doing business in the United States they will not be using it for another 6.5 years when the patent is then expired, unless they have our permission of course. Fi does think that Fi is going to keep that patented technology all to itself...because..guess what, it belongs to nobody else but Fi. (Little hint, the guy who previously owned the patent is not using the basket any longer...that might be a little clue to you, he has resorted to his 15" and 18" lightning storm baskets)

Like I said, the patent is not "yours" yet. Maybe in 6.5 years but until then it's not yours. I take it none of the spider setups will work because TC still owns that spider adapter correct?

Also RAB has seen it in person and we thought the same thing. I could point out many ways there would be issues with the spiders that which I told Scott.

Looks like Thilo is smart enough to avoid getting into a lawsuit. He's changed all of his baskets away from the 6 spoke appearance design that he once owned. There's his product lineup on parts express...

AFAIK Scott BOUGHT the patent when TEECEE went bankrupt. So, AFAIK, they OWN IT. NOW.

Audiopulse went under not TC... As far as I'm awar TC will be back up in a ouple months using the same basket with color options and it will be readily available like it was back then. I know plenty of people who still buy baskets, top assmblies and woofers from TC including myself.

What they had was a fire sale to get rid of Audioulse.

AFAIK you have it exactly the opposite. I'd be more than willing to admit I'm wrong, but I haven't read anything...

I'll see if I can dig up the TC stuff later, headed out for the evening...

It's all still a bunch of "heresay and hog-wash" to people, so only best thing to do is wait a couple months when I get my T3 woofer and TC is back up. I dont see them stopping production any time soon. And from what I was told, they dont plan to. :p

I would give you Kyle K's number but i dont like giving out that info. PM him and he will clarify it up for you. Hell even the secretary at TC will tell you this.

1) Do you not understand the concept of purchasing a United States patent at the bankruptcy auction? The intellectual property (Ornamental appearance patent) is no longer property of anybody but Fi, it does not belong to Thilo any longer. It was originally designed and patented by Thilo for Eclipse, but after the QC issues they left TC sounds for an oriental build house. Thilo, still had the intellectual property (Known as an ornamental appearance patent) cornering the United States market. Which a patent is worthless, if you do not enforce it. Which is why you see so many people using it now..because it was not enforced, as it takes money to enforce it. Again this is for a 6 spoke appearance, they can use the 4 spoke (Which is the 10" and 12" appearance) all day every day as Thilo still owns that patent and could care less about it.

2) TC doesn't own the spider adapter, because we tooled one of our own. The spiders that are available on the market will not do what we want to do, so we tooled those as well...which is really funny how you have "seen" everything because what you think you may have seen..really is not what it is.

3) You held the original prototype in your hand, that was nearly a year ago. It is sitting in the corner of the office where it has been for months. You have not seen, held, smelled, touched, or licked the real SMD, much less the new motor technology that we have developed.

As I said, you know..nothing.
