Bad situation need forum advice...

you were in ohio? i assume that because your location says cleveland.

weed is de-criminilized in ohio which means you will get civil citations e.g. a ticket and a fine. the alcohol should just be a fine at most, but you can probably get it thrown out because if your car was parked and you were not in it, there is no way to prove that the beer was yours or that you put it there.

 
As far as I am concearned the initial search was not legal. All you need is a friend thats over 21 (I assume in your state) to say they forgot their beer in your car, or say they left it there and were comming back for it. As for the weed explain you give rides to all sorts of different people and it could be anyone's.

A good lawyer will get you off.....

plead guilty because what you did was wrong...and come into court high and drunk to show remorse for your actions. This is what I gather is the best advice from reading the 15 legal threads a week in here. YOU WERE WRONG, OWN UP TO IT. Forget due process!

One of the billion things I hate about people is the lack of accountability. I expect a kid to say, "I didn't do it." I don't expect it from a adult, and **** sure not from a grown *** man. For some reason society is full of people who either can't or refuse to be accountable for their actions.

Depends...although not relevant here, it could be in the course of duty. I sometimes transport boxes and information I am not allowed to see.

 
i highly doubt he's gonna get jailtimei told a cop i'd slap the shit out of him if he wasnt wearing that uniform and i didnt even get in trouble =)

Hire a lawyer, and whatever you do, don't forget to pay your lawyer! A lawyer will probably keep you from doing time, but you will have to admit you were wrong, and act like you're sorry. If you don't pay the lawyer, they'll have you revoked. I don't know your local laws, but you can count on getting probation.

Whether you had smoked again in your car isn't the issue. You're the owner of the car, and it's your responsibility to know there's no weed in your car. If you're too high to remember where all the dope is, you're too high. **** it up, and quit trying to find a reason it's not your fault. There's nothing that pisses a judge off quite like that lack of logic.

BTW, this can be the power of an attorney; My kid passed out while huffing last year, went through about 5 yards, and smashed into a brick mailbox. He totaled out his best friend's car, but fortunately nobody was hurt. He wasn't charged with DWI (which he should have been), didn't lose his license (which he should have), and didn't do any time. He worked out the damages with the owner of the mailbox. The same week, a girl his age, in our town, passed out while huffing and hit the corner of a restaurant. She's doing 90 days in jail, and won't be driving for a couple of years.

Get ready to have your license suspended except for school and work.

I was working as a salesman at a big car dealership last year. I went out to check out a really nice old Camry we took in trade. The interior smelled a little funny, so I opened the ashtray. Yep, it was full of roaches, and there was a small bag of weed. The woman who traded it in was in her 50's, and an advertising executive. The point? I've never met anybody who burned in their car who could remember leaving weed in the car. That includes my mother.

 
Well i went to the court today and plead guilty to the first to charges and am doing some kind of diversion program, im meeting with a lawyer later today about all of it. So as of now i got like 250 in fines and 3 months probation. The first search of the car could possibly be illegal because i told the cop that the beer was my friends who was 22 and he could come pick it up if needed but the officer told me that you cant do that and searched the car anyway. And i havent smoked since getting in trouble.

I didnt even smoke the 2nd time in trouble there was just a roach in the car and that beer i had no idea where it came from or were it was, obviously it wasnt visible because i vacuumed the car and cleaned it before then. So for all the people with usless comments and flaming idc go **** yourself i was asking for advice for the situation not for you dumbshit two cents.

So im just hoping that i get no jailtime because im pretty positive that im not smoking weed ever again after this, i honestly cant risk it so theres no point to it anymore its not worth being paranoid about and not worth the money either.

First we need to know why the cops pulled you over and searched your car the first time, the second time everything is legal, you did a violation and a K-9 search outside your vehicle is not a violation of your 4th amendment, so you are stuck with those tickets, lucky for you they are chicken shit misdemeanors, dont take the first deal, you should be able to get away with a fine and community service.
