Bad situation need forum advice...

So the other day i got in trouble for having a bowl and alcohol in my car, since im 19 i got in trouble for the case of beer too. The cops apparently looked through my car when i wasnt there through the windows with flashlights and saw the beer so they searched the car and found the bowl. The previous day the car was smoked in so it did still smell like weed and the bowl in there prob wasnt helping, so the 2 cops searched the car for about 10 mins got all the alcohol and weed out i presumed...So i got charged with prohibitions and paraphanalia.

The following day i go drive my car thinking that everythin was found. My car still kinda smelled like weed but i thought that was because we smoked in it and it would eventually just wear away.

So Im driving trying to follow mapquest directions i was about to pass up a street so i flipped my turn signal on slowed down and went across 2 lanes to get in the turning lane. Then about 2 mins later a cop pulls me over. Now the day before i was charged with all that stuff the cop was like is there anything illegal in the car that i should give him. I thought that there wasnt so he said he was gonna bring a dog. The dog started to bark and they searched the car for about 30 mins. They found a single can of beer and a roach in the car. Now i got a ticket for changing lanes, possession and a summons for the can of beer and then they let me go. So now i got 5 tix in about 2 days. Ive never been in trouble before cept getting an auto ticket.

So what advice or what would you do in my sitiuation, my court date is thursday and friday this week. So any help would really help me. I know i learned a lesson from this whole situation so please no say any of that and please tryna give some helping advice for the situation.

Nothing much advice I can give except to try to be safe next time. I would figure you would learn your lesson after being busted the first time. Until you make wiser decisions, it's going to be hard. I don't think anyone will have meaningful suggestions on how to beat the rap.

the thing is that stuff was left in there the first time the car got searched, thats the worst part about it i learned a lesson or at least i would of till the court date for that but getting pulled over again when i wasnt even doing anythign to get re charged for the same shit...

When I lived on campus, I was stopped by two cops while I was carrying a lot of beer in the van...had to dump it out, but other than that they didn't bother me...

you got caught with dope and beer in the car and they let you go? And then the next day you get the dogs brought over to your car? Something is not right. I think you smoked your car out again. The smell would have to have been strong enough for them to warrant probable cause. Next time (and there will be a next time) Febreeze your car down after getting high in it. And don't designate your car as the smokemobile. I don't even let people that smoke anything in my car. I mean if you get pulled over and your stoner buddy is in the car, and some weed just happens to fall between the seats, they will be coming for you. I believe you got high again in the car even after you were pulled over. You may have to do some time for this shit.

Ditto. Very true words. If you choose to do risky things, you're eventually gonna get caught. I expect to see a reply about how you thought the cops had taken all of the stuff out of your car and you shouldn't be responsible if they left some of it in there, blahditty, blahditty, blah... still your stuff.

Bottom line:

bad circumstances + bad choices = bad consequences

Sucks to be you.... lean on the mercy of the judge, there's not much fighting this one, it sounds like.

Only thing I could see would be the legality of the original search... just seeing a case of beer through the window of a car that is parked isn't really probable cause for a search, if you ask me. If they searched the car without your knowledge or permission, then they never knew you were underage, hence they made an ASSUMPTION that the beer was illegal when it might not have been. Even empty alcohol containers in a parked vehicle shouldn't be considered probable cause, IMO.

Now, if they KNEW it was your car, and KNEW you were underage (maybe they ran your tag and figured out your age?), or if the windows were down and they could SMELL the pot in the car... then that would be probable cause, I think.

You could still be f00ked, but that's about the only thing I can think of for the first incident. The 2nd is just plain bad luck, and I think you're screwed. Your actions in driving sound suspicious (in the eyes of a police officer observing traffic), which alone could be enough cause to search your vehicle if he says he thinks you were intoxicated at the time... did he administer a field sobriety test?

Oh well... just some random thoughts...

I have been caught with booze. It was in my pocket and I wasn't driving. So they just told me to pour it out. Now if I transport booze after a party or something, I put it in the bed of the truck. So atleast it looks like I am trying to be responsible.
