im sure somewhere in the agreement it states if you are 6 months in delinquency they have the right to sell the account to collections. the bank/credit card has already been paid by the law office/collections. they have their money now the collections is going to collect their money plus interest.I wouldn't make a single payment myself. As soon as you make the first payment, you're agreeing that you owe the debt to them (which you don't, you owe it to the bank or the credit card company, not the collection agency).

$170 being the actual amount the bank paid out of pocket, the rest being interest which they would not have made (26+% more than likely on his account) back on a typical loan (9-15%, not getting techinical, but it wouldn't be anywhere near 26%). How much they truly lose outside of the $170 really can't be determined.The 170 is probably just a fraction of the interest he has paid on the thing in the first place, if you want to get all "moral" about it. How is asking for proof "blowing holes in his credit"?

The fact is, he owes the money to the bank, not the creditor, and if the creditor had legal precident to collect on that money, they wouldn't have to send a written 30 day notice as outlined in the "Fair Debt Collection Act":
* After making contact, debt collectors are required to send written notice informing the debtor of the amount of the debt, the name of the creditor, and the fact that the debt will be considered valid unless disputed within 30 days.
If it was already legal, as you claim, that default letter wouldn't even be needed. And you should still verify your debt before you just start paying random people money.

It is actually AGAINST THE LAW for her to be rude to him while collecting a debt. They can legally be sued for it. He's perfectly right to be upset at being treated like that, especially over such a miniscule amount of money. She broke laws in doing so and abused his rights. They don't have to act like that to collect a debt that isn't even "legally" owed to them.
I personally would make them go through hoops to prove everything, from her name to her company to the original contract before I even thought about paying the debt, just for the way she acted. I'd definately make sure the debt is legit before just going and paying it. Any jackass can put something on your credit report, I could do it if I knew your SSN. Should you just pay that debt too without asking for proof?
It's the law for a reason, it's to keep people like her from abusing and harassing people. Obviously people like you don't force them to abide by the law, so they don't. If more people actually stood up to them and called them out, maybe sued them, maybe they'd start to obey the law and act right. They treat you as if you're a criminal for being deliquent on a debt, when they're abusing your rights and breaking the law themselves trying to collect the debt.
