I wouldn't make a single payment myself. As soon as you make the first payment, you're agreeing that you owe the debt to them (which you don't, you owe it to the bank or the credit card company, not the collection agency).
im sure somewhere in the agreement it states if you are 6 months in delinquency they have the right to sell the account to collections. the bank/credit card has already been paid by the law office/collections. they have their money now the collections is going to collect their money plus interest.

 
See, if they were really lawyers, they would know this. This right here would tempt me into not telling them the phone conversation is recorded, and then just record their business practices and hope it's the same chick that was rude before. That's some good evidence right there.
must not be too many collectors getting sued though because they all do it. they scare you into paying them.

OP just pay the debt and be done with it.

 
I WILL beat these little azzholez...I was harrased in a very unpleasant way..I will wait for her to call back and have a recorder handy. This has been 2 years ago! Why are they just now doing something about it? and as said OVER $250 They will spend that in just 30 mins for a lawyer and stuff, court cost etc..

if it was sold to a collection agency, then they cant do anything about it. its usecured credit which means they cannot take something if you dont pay, all they can do is mess up your credit score(most likely it already is). these collection agencies "buy" your deliquent account for pennies on the dollar. then they go after you for the full amount. if you keep tellin em i dont have the money, you can jew em down to at least half of your bill. maybe even more.

250 is peanuts, i dont even know why they they try so hard for that amount. they will most likely spend more on collecting than the money they get back.

Of course she's going to sound like that, you're ruining your credit over $170. She asks you when you're going back to work, and you say "when they call me to come in". Do you realize how pathetic that sounds?

A bank/whoever you owe is out $170, and you're going to complain about a woman's tone of voice?

$170 over two years? What is $170? Two weeks work at McDonalds? Honestly. You're going to blow holes in your credit instead of taking a two week stint at a $7/hour job?

Maybe instead of looking up how to skirt responsibility you should look into getting a job.

The 170 is probably just a fraction of the interest he has paid on the thing in the first place, if you want to get all "moral" about it. How is asking for proof "blowing holes in his credit"?

The fact is, he owes the money to the bank, not the creditor, and if the creditor had legal precident to collect on that money, they wouldn't have to send a written 30 day notice as outlined in the "Fair Debt Collection Act":

* After making contact, debt collectors are required to send written notice informing the debtor of the amount of the debt, the name of the creditor, and the fact that the debt will be considered valid unless disputed within 30 days.

If it was already legal, as you claim, that default letter wouldn't even be needed. And you should still verify your debt before you just start paying random people money.
$170 being the actual amount the bank paid out of pocket, the rest being interest which they would not have made (26+% more than likely on his account) back on a typical loan (9-15%, not getting techinical, but it wouldn't be anywhere near 26%). How much they truly lose outside of the $170 really can't be determined.

I never claimed I'd make checks out to a collection agency, and I never claimed it was legal. Nowhere in my post do I address the legality of the situation.

If the collection agency does legally own his debt and has the right to collect it, why the hell would you expect them to be friendly?

Why do you expect ANYONE to be friendly? She made no threats, and she wasn't harassing. She asked questions in a tone of voice you didn't like, she can look down on you if she wants, and she can be a ***** if she wants. They're not in a sales environment, customer service is not an issue.

But talking about "getting those assholes" and recording the conversation isn't going to get you anywhere, and does nothing but make you look worse.

It is actually AGAINST THE LAW for her to be rude to him while collecting a debt. They can legally be sued for it. He's perfectly right to be upset at being treated like that, especially over such a miniscule amount of money. She broke laws in doing so and abused his rights. They don't have to act like that to collect a debt that isn't even "legally" owed to them.

I personally would make them go through hoops to prove everything, from her name to her company to the original contract before I even thought about paying the debt, just for the way she acted. I'd definately make sure the debt is legit before just going and paying it. Any jackass can put something on your credit report, I could do it if I knew your SSN. Should you just pay that debt too without asking for proof?

It's the law for a reason, it's to keep people like her from abusing and harassing people. Obviously people like you don't force them to abide by the law, so they don't. If more people actually stood up to them and called them out, maybe sued them, maybe they'd start to obey the law and act right. They treat you as if you're a criminal for being deliquent on a debt, when they're abusing your rights and breaking the law themselves trying to collect the debt.

Making threats against him, and calling him every waking minute, I would understand (harassment). But not her tone of voice.

its no longer that $170...all the interest and bullshit accumilated has now escalated to OVER $1000 i can just bet on that im pretty sure.

edIT: Man, this is Arkansas...There aint shit where I am at nearest "city" is 65 miles away..which I know thats no excuse but I have tried at the prison, every factory around this area..thats why I was trying to sell my subs and stuff to pay up on some of my backed up bills and crap. I've got a job that I start monday or tuesday of this next coming week.

Yes, that $170 you sat back and watched escalate to over $1000.
Well that and not everyone has a job to where they got extra money to spend, I made $400 every two weeks, that was for truck payment, insurance and gas back and forth to my last job.

I had gotten the credit card when I was working for my amp helping install control panels and conveyor belts for some good *** money, then that went all to hell and was stuck with no money to pay bills, like what has happened to me again! Can't help it when you get laid off from your job:)

 
Also, not to mention that she NEVER ONCE stated the agency she was calling from, nor the creditor as to which she was attempting to collect the debt for. So how you explain that bullshit?

 
I actually agree with Cheese here...

a) I would have told got equally as rude with her. If you have nothing, they can't take anything

b) Make them find the paperwork. People are also using this as a way to get out of mortgages. Say your loan has been syndicated 5 times, rolled into a MBS, etc...no one knows where the actual loan you signed is. They have to be able to find it. If you are in deliquency, it is a good way to buy some time.
