I got paint on my vehicle in a designated parking area at work while the place was being repainted.

They are dragging *** on this (8 months - still painting) and said they would not pay for the repair if we (more than 60 employees) got the damage fixed on our own as they (company) are not turning this over to their insurance. Suppose to get "some guy" to come in and start buffing the paint off of the vehicles.

Some of the employees have gotten estimates as hi as 5K to do the repair work.

Do I have any recourse in this matter? Is this legal? What if I dont want this "some guy" working on my vehicle?

My vehicle is 10y old. I just started putting some money into it. System, wheels and upholstery work. This is really starting to **** me off to the point I may have to see what legal action I can take.

What are your thoughts on this?

 
Who was doing the painting? Were you supposed to park there for work? Were these painters working for your employer? I would charge the company doing the painting. It is their responsibility to ensure no paint lands on your vehicles.

 
I work for a winery, and this very scenario happened. I don't know if it's because the company that owns us is huge or what, but they paid for everything. I think your employer should be responsible for the repairs. You didn't ask for the damage, and it happened while at work on their property.

 
We were in designated parking areas. They are not actual painting contractors - general labor contractors working under managements supervision or following managements orders. Do what they are told and ask no questions or hit the gate.

It is kind of a gray area where their liability ends and the company's starts if that makes any sense.

Good point - I will ask the Manager if the company is taking responsibility for this or if I need to contact the contracting company.

This may be the reason everybody feels like they are trying to sweep it under the table as they are trying to decide who is going to pay for all of this.

But...... I dont feel like I should have to deal with ultimatums and be forced to let a unestablished "some guy" work on my ****. This is personal property that has been damaged (or will be damaged after the repair) not industrial equipment that can be written off as wear and tear.

I feel that a insurance adjuster should be brought in and do a vehicle by vehicle inspection. Vehicles range from Caddy to soft top jeeps to beaters so I would expect there to be a different dollar amount of damage from vehicle to vehicle. Whatever that amount is I should have the option to get my vehicle fixed where I want.

I just want my **** fixed right - not just because it is the cheapest bid.

Appreciate the opportunity to vent about these arrogant bastards.

 
I hear you bro. At my job, all contractors are considered temp employees. Even temps are responsible for damages and are covered by plant insurance. Ask about your policy. I just think your employer is responsible for the damages period!

They do not get to choose who repairs your vehicle. That would be like someone hitting your car and saying "well I'll pay to have it fixed but you have to let my buddy do the work." You just can't do that, they need to pay for it, and you get to decide who does the work. If they're dragging their feet I would definitely talk to someone, an attorney would be good but you might try your insurance agent first, they might be able to give you some advice.

Not sure all the details but one of the quotes was from the Ford house. Guy was told if they had gotten to it sooner they could have gotten the paint off of the molding. Said that the paint had bonded to the molding so all of it would have to be replaced.

If I get a chance I will try and get a few shots of my windows. My vehicle is silver and that is what color some of the over spray is. Whole vehicle feels like sandpaper.

This is exactly what I think is going on.

Most of the vehicles are financed and have full coverage insurance. Isn't that suppose to protect the lenders interest in the vehicle? So if the Company drags their feet until a employee files on their insurance - the Company could be sued by the insurance company. But.... wouldn't the employees policy increase in price?

I think the manager is trying to play adjuster and this if going to turn into a can of worms.

 
Just get an estimate of the cost for the repair, ask for the name of the company that did the painting and file suit against that comany in small claims court.

Unless of course the company you work for is so crappy that they just hired a bunch of random Mexicans to do the work. How crappy is the company you work for?
