Should I sue?

Last week on Wednesday night, my kitchen sink got clogged. The next day, when I got home from work, my manager, his wife, and a plumber was in my kitchen fixing the clog. This was all done without my permission or even notification that they were going to enter my unit. Well, I contacted an attorney friend and he told me he'd look into it and call me. Since this happened, I got into an argument with the landlord and put in my 30 day notice. The law is 24 hours written notice. I feel like my rights as a tenant has been violated. It's not an emergency, IMO since it did not involve the unit having a flood, fire, or gas leak.

What do you guys think? Should I sue or not?

What damages did this cause you? In my opinion, since you have none, you cannot sue since there were no damages. All you can do is get your landlord arrested.

Did you file a maintenance request when you found out it was clogged? I'm assuming you did, otherwise how would they have known it was clogged in the first place. Unless you specifically told them NOT to enter without your permission, then I don't see where the problem is.

I mean, the way I see it, you filed a maintenance request, they came and fixed it, and now you're mad. Wtf man.

I didn't file a report but I did let them know that my sink was clogged the night before. They gave me some Draino and I put it in, went to sleep, and went to work in the morning. I never put in a request for them to fix it as I thought it was just a minor clog and the Draino might have unclogged it. I never gave anyone permission to enter my unit either. It has nothing to do with making an extra buck. Don't anyone care about rights anymore?

It seems like it IS about an extra buck. They tried to help you. You asked for help and they gave it to you. Doesn't anyone care about respect anymore? You have no right to their money either legal or moral.

Of course we do, but you never told us in the beginning whether it was based off a maintenance request or not; but now we know.

Honestly, I would tell the landlord straight up you feel violated and/or offended, but unless they actually stole something or broke something, I don't think there's anything to sue about. Hell, at least the landlord took it upon himself to get the shit done - I know some people who's apartment managers wouldn't give a rat's *** if their kitchen was on fire. At most, ask him to never do that again without permission and try to get a free months rent out of him.

You haven't suffered any damages yet you want to be compensated? You could move out without giving them notice right now since they're not aloud to enter without your permission but as far as getting money I doubt it. Unless they broke or stole something.

That's how I saw it. They tried doing you a favor by trying to fix it and you saw this as an opportunity to sue and make some money. lawl

No you can't sue, that is some shady shit though. Legally they aren't allowed to enter unless you give them permission but most of the time the maintenance fags do it anyway...

If your that upset about it just tell them your moving out and if they ***** about any early termination fees or anything just tell them they entered your apartment illegally and you'll see them in court.

Care about respect? How about respecting my privacy? May I add that my landlord lives next door to me and takes every opportunity they can to stare into my unit to see if it's clean or not? That's a charge by itself.
