Sold "new" Sub Came Used/damaged

If you buy a subwoofer in "new, unpowered subs," yet upon shipment it shows obvious signs of use, what is the fair solution? I figure if it's broken, it should be fixed. But, what about the mislabeled condition of a product?

It may work, but it's not in the condition the seller stated... What is the middle ground?
