Legal advice

talk to a lawyer.
I don't want to do that yet, I am waiting to see if they are going to fire the supervisor that brought a gun to work and threatened me and another employee. They told me they might fire all 3 of us, even though I really have nothing to do with it, other than a misunderstanding. It's really a long story, that's why I didn't bother typing it out. I already told the company if I am fired I will seek legal advice, but in florida, I believe you can be fired for anything and not even have to give a reason. So I am trying to find out whether that is true before talking with a lawyer.

 
Did they call the cops or anything? if you can't get $ for getting fired... then quit before the f@gs fire you. Say you are emotionally unstable and do not feel comfortable working there now. I bet there are many things you could do. I bet they would also be in legal trouble if they didnt call the police and what not... even if they did call the cops you should still quit and file unemployment, if ya wanna fok em over //content.invisioncic.com/y282845/emoticons/biggrin.gif.d71a5d36fcbab170f2364c9f2e3946cb.gif.

 
It's a family owned company, at first they tried sweeping it under the rug so to speak. Then I told then the guy's own family members warned me that he shot his own brother, and it was no accident. So I told the owner that I cannot work in teh same place as that guy, he told me several times that he would kill me, even after I told him that I have no problem with him. It started because another employee was having problems with him, and the employee asked my advice, I told him to talk to the owner, quit, or tell the guy to kiss his @ss. He chose the latter, and in doing so, told the guy that I said to tell him that he could kiss his @ss. So the supervisor told the employee that he was waiting in his office for me to kick his @ss. (thank goodness I didn't go in there and ask what it was about, he probably would have shot me as soon as I walked in the door). 5 minutes later the supervisor confronts me and tells me to try and kick his @ss, I told him I never said that, and he kept trying to provoke me to hit him, then told me he would kill me. I laughed and said what are you going to shoot me, he said yeah, then told the other employee he'd put him in the grave too. The guy even gave reasons, such as his back problems, as to why he wouldn't hesitate to kill someone. I told the owners this guy is a safety issue, and I felt I handled the situation properly, and if I am fired, and/or the guy is not fired, I will seek the advice of an attorney. The police were not called, and I'm not sure whether I should make a police report or if it's too late, it happened early friday morning.

 
never to late to file a report if your life was threatened. I'd do it. Press as many charges as possible.

well I don't want to make the situation worse, so that is why I am asking, I guess I can always call the local police dept tomorrow and ask. I just don't want this guy getting served some papers, and in turn getting more angry, wait for me to show up somewhere and pop a cap in my behind. I don't handle pain very well, I'd probably die if I was even shot in the toe.

Odd situation man, never been in your shoes and honestly don't know what I'd do. I wanna say go file a police report, but like ya said that could make it much worse. If he truly wanted you dead, I think he would have pulled the trigger.

That being said, the best thing you can do is talk to them and get it on record BEFORE anyone else says something and shit gets out of hand. The reason I say this is that if you end up having to go to court eventually, you will probably claim that your life was threatened. The first thing the judge will say is "If you felt so threatened that you will testify to it in court, why did you not seek police help immediately?" Depending on the way shit works, your case will probably be dismissed and your guy will be left on the streets.

If you feel strongly about your situation...go straight to the police station and file a complaint. It costs nothing and nobody will know about it but you. The only thing it does is document that you said something in case something happens in the future and you need to back your story up.

I'm not making a case against the guy, I'm just preparing in case I get terminated or if the company doesn't terminate the guy, to seek legal action against the company itself, and possibly seek a severance pay or something of that sort. I really don't want this to go further than it has gone. I'm giving the company a chance to make things right, if they choose not to, then I want to know where I stand and what options I have if any.

 
I forgot to add in the PM, that no they do not need a reason to fire you. But since you have a good reason to leave (your life was threatened) You may apply for benefits. But that right there is a legal battle, and still need the police report.

did you read my post? you dont have to make a case to file a complaint. filing a complaint IS preparing for the worst. cover your bases is all im saying.
