That, as a blanket statement, is wrong. There are exceptions to every rule. The exceptions that I know of which apply in my state do not apply to the OP but saying he is covered just as long as the car has current minimum liability coverage is more than a bit foolish.

Sounds like if he overtook (passed) the other car on the right he is at fault since he made an illegal manuever and therefore his insurance pays. YOur insurance mos tlikely wont go up as long as you dont have any tickets or previous wrecks.

That's what he did, but you know how insurence companies are..... i am 20 and not on my dad's insurence.... No recorded wrecks before, my speeding ticket got dismissed a few weeks ago besides that my license is clean
