While 01SVTCobra's advice was right for the most part one thing that might be a snag is this:

I do not know about where you live but here in Louisiana insurance coverage on a vehicle covers anyone legally able to operate a motor vehicle while they are driving a currently insured vehicle....excepting...if you are not specifically named on the policy covering said vehicle and you reside at the same address as the main policy-holder.

Ergo: If your driver's license shows your dad's address and you are not specifically named as a covered driver on his policy then your father's insurance company can deny any liability for any claims arising from this incident.

Not trying to hate and I do not know if this is even applicable in New York state ~ just telling how it is here and that similar things might affect you as well.

i hear you i appricate your time, we dont live together, the address on my license and his license are different

 
his (the other driver's) insurance should definately cover it...
yes sir he overtook the car that stopped for me to pass through to go in the shop, he overtook him on the right side.. He messed up my passenger side fender and bumper, and my wheel alignment

 
Sounds like if he overtook (passed) the other car on the right he is at fault since he made an illegal manuever and therefore his insurance pays. YOur insurance mos tlikely wont go up as long as you dont have any tickets or previous wrecks.
