HELP!! very important legal question!!

can the hospital reveal information that i was high? cuz the doctor asked me if i had taken any drugs and i told him i smoked some weed earlier, but it was several hours before the accident.

doesnt matter who did what, if they sopeana the medical records and there is a note about smoking pot in them prior to the accident and they find some in the car it is gonna be a hell of a court battle

i would bet it evens out, she pays for her shit, he pays for his

Well, If she stole her car from the pound, Chances are its all done. She will never be found, She probly had fake ids and stuff, and the car is unregistered, uninsured. Your Insurance company will fight you on it, cause they will check your medical records, Ya the will, cause you may claim injury, And you told the Dr. you were high? You better start looking for a 2n or 3rd job to buy a new car, cause Insurance will probly shoot you down with Denied.

Btw, Im not a lawyer, But I watch CSI and Law and Order.

if they run a drug test on you and you fail your pretty much screwed

insurance might not even cover the wreck

i can almost guarentee if u were high ur ****ed if not dont worry i know this because same applys to drunk or intoxicated drivers. i am preety sure at the hospital they did blood work . unless u get a good lawyer who can say the weed in your system has nothing to do with the case . EITHER WYA SORRY TO SAY U FAIL!

If the cops think either of you were under the influence of anything they'll search your car, it's all part of their accident investigation. Depending on the police dept it could also be standard procedure to check both vehicles for any signs of drugs or alcohol. You could be screwed on this one, but since you were dumb enough to be smokin and not wearing your seatbelt to begin with you'll pretty much get what you deserve.

doctors ask if you take any drugs in case they have to give you more, they don't want anything to counteract with each other, etc. Even if they drug tested you, there is no way they could prove it was before/during the accident that you were high. Unless they drug tested you @ the hospital, right away. And even then, you have patient confidentiality. And without a good **** reason, the cops won't supeona those records. If she rolled through the stop sign, it's her fault. all the cops will probably do is write tickets and say that it was indeed an accident. I'm pretty sure you will not be in any trouble and you will get your car paid for.

thats what i'm hoping. will my medical records say i was high? what kind of information is in the records? i dont think they wrote that down that i took marijuana tho, they just wanted to know in case they had to give me some other drugs or something. correct? will the insurance companies see the doctor's report?
