its a conflict of interest in my opinion the individual has the right to complete work on his own time as long as it does not take customers from the store as mylows said... i actually run a shop that installs dish network services home theater etc.. Techs sign a company policy agreeing to the terms of "side work" reason behind that is because company tools, parts, etc can be used and in some circumstances interfere with a work schedule you would be surprised how many times guys call in sick and you see them out doing side work. As stated there is a fine line friends family whatever but taking potential business from your employer not the best idea.

This is what is called a 'Conflict of Interest'
I'm a cable guy, I always have people asking me to do work for them. Most want stuff free, so I tell them no. I could not use my company issued tools, truck, supplies to do work in a person's house. I could use my own, however.

When you are taking business from your employer, you are risking a lot, depending on your employer. Do you really want to **** off the guy who signs your paychecks?

what i'm saying is ,if he's using his own tools ,on his time ,and not taking customers from the shop ,then it's his business not the shops

 
If the business comes in no way from any connection to his employer, it is his business, He should be using all of his own supplies though, also off the clock only. If he is fkinding his own customers it's just free enterprise.

instant termination and withhold current paycheck for recuperation of stolen business. a friend of mine posted an installers entire tool box with tools on craigslist, after tool box was picked up and sold, guy came in to work and fired guy and had police escort him off the premise.

yes this is true ,but if the employer fires you and says its because your doing side jobs ,thats a type of discrimination

Depends on the circumstances, but it's possible. Say you're a mechanic at a dealer, there's nothing an employer can do if you post ads on CL and work on cars in your own garage. Same concept. Now if you're handing out your phone number at work saying you can do it cheaper, that's cause for termination.

i'm sure the same holds partially true here but too much BS to go through for that. plus we are an "at will" employment state and Napoleanic code is how our laws are govern here in Louisiana so things are different.

That would be theft if sold the installers tools, not exacty a smart way to handle things....

 
HHere's another thought, if you have a guy that is good enough and smart enough to get work on his own.

1)dirt pay him enough so that he's not looking for extra work.

2) offer him incentives to bring business to the shop himself.

90% of owners out there (who started the business themself) probly did the same thing to start their shop. You start small then expand.
