so youre telling me that youre going to tell a cop 'well i have this right , and ive read this here , and that says you cannot search my car no matter what and you have to let me go'? i think not. and for one , if you do have shit in youre car , more than likly you will not reacall every right you have and know exactly what to say to please that cop and actually have him let you go. and not every cop knows every right and every case that has went on in other states 500+ miles away and what the result of that was.

like buddy said , you just cant be riding dirty and expect not to be search as long as you tell them no. if it was that easy....lol.

actually i had a good lawyer. you must be 1 of the dumbest people ever to think you can ride around with illegal shit in ur car and be ok as long as you say no to a search.

Where is their probable cause to search me? Just because I was speeding or didn't make a complete stop? If my car smelled like weed then they have every right to search me.

if they have no probable cause they have to ask. if you say no, thats it.
only way that they can search your car w/o your consent is if they SEE something illegal, SMELL something illegal, your car is suspected to be involved in a crime (which probably equates to a warrant), or a search warrant.

please explain if i'm wrong. thats what i just read

or if you look intoxicated , jittery , or anything that looks suspect , i think they can. also , how would you know if a cop tells you that a car that looks just like yours has been involved in a crime is true or not?

no. she had a warrant for forgery. that does not constitute a search of the car.

which means once in custody they have the right to search the vehicle.

explain this

lets say you were pulled over with a warrant.

you are arrested.

when your car is towed the cops have to search to inventory all items in the car for YOU so if anything is missing you have proof.

during this time if anything else illegal is found it just adds to your charge.

Why do people try to fight the system so hard? If you spent half of the time you spend looking up laws on how to hide drugs and say no to cops to something productive, you would be a lot more valuable to society. Instead of whining like a child why not become a police officer and change it from within. Remember citizen or not, you are no where near as powerful as the police, saying no and showing them "the books" will not do anything, they should laugh in your face.

No, you're going to be polite. When they ask to search your car, you respond "I do not consent to a search officer." and then shut up. If they don't have anything to convict you of, they don't have anything to convict you of. Simple as that. Even if you have dead babies in the trunk, if he doesn't hear, see, smell them, he has no probable cause, you're free to go. Why would you ever admit to something that hasn't been discovered? I'm not telling you to lie, but admitting fault is unnecessary and stupid.

I always get a good laugh when people that dont know shit start talking about the law.

Probable cause has NOTHING to do with searching your car.

I am going to let this thing roll along for a good time, but you might want to do a search on the term....... Oh shit, I cant even remember it. Reasonable suspicion.

Some of you in here talking about probable cause and you dont even really know what it means.

Lets just make this simple for you guys that think you are TJ hooker.

A cop can make up any bullshit they want as to the reason they pulled you over.

Once they start talking to you, they can make up any other BS as to why your actions made them have a "Reasonable suspicion" as to why they searched your car.

Reasonable suspicion and probable cause are two different things, one is less of a burden on the cops than the other, and it allows a cop to search your crap in a car on the road where you have NO RIGHTS of privacy. So stop thinking you know the law.

I learned a few things in law school, and one thing is that very few things are as black and white as you want to make them out to be.

I have pulled myself over at least 3 times, maybe four. So when a cop starts riding your ***, just pull over. Doesnt matter where it is, just pull over. Doesnt go over to well with the cops, but oh well. Id rather tell the judge I pulled myself over because he was riding my *** then let the guy keep following me and make up some BS.

We're not "fighting the system". We are educating ourselves to better understand our rights as americans so that we are not taken advantage of.

i'm not 100% on this but...(this has happened to me, in fact)
if you say no to a search, and end up getting arrested and they tow your car: they have to "inventory" the car.

this is where i'm not sure... being that you said no to the search, and they "inventory" and find say, an ounce of weed. i'm led to think it is unadmissable evidence, as they were denied a search. they should write down the contents of the car, and thats it. otherwise it's an illegal search and all evidence will be dismissed when it goes to court. (providing you can prove this, and have a good lawyer)

partly true yes, you would have to have one hell of an atty though

although with already having the felony warrant there are very few courts or judges that would throw it out.
