Are cops allowed to do this?

This is a great thread simply because some of you are learning some good stuff as a result of a debate.

Those of you worried about our rights(and rightly so) i am going to give you a little scenario and see how you like this.

You are arrested and charged with some drug crime.... possession with intent to distribute cocaine or something. Later, your house, car, boat, and everything else you own is seized using asset forfeiture laws.

6 months goes by, charges are dropped as the DA feels they do not have enough evidence to get a conviction. Here comes the fun part........ are you ready....... you dont get your shit back. Tada!!!! Arent you glad you live in America where you are innocent until proven guilty. Hell you werent proven guilty, you werent even taken to trial=, but your stuff is bye bye.

Now you get to go get a lawyer and you have to PROVE your stuff didnt come as a result of drug sales.

So put that in the pipe and toke on that for a while.

Doesnt something seem wrong? The police dept who have budgets that are really tight, get to go and make money thins way??> Oh yeah, i forgot to tell you, the money that comes from selling your shit goes back to the police depts, or at least a large % of it.

Have a nice day sir!
How can they sell your stuff if you're not proven guilty?

EXACTLY!!!!dont get me wrong the US is a great country

but

places like china, iraq, etc....

at least there you know you have little to no rights.

unlike here in the good ole USA where yo think you have rights but in all honesty you have the same as they do in other countries.
just because you live in springfield illinois and hate life doesn't mean the whole country is a sh*thole

just playin :p

just because you live in springfield illinois and hate life doesn't mean the whole country is a sh*thole

im basing what i said on reality. it has nothing to do with my life or where i live.

just playin :p

Do some research on ASSET FORFEITURE. It is the only law of its kind and totally unamerican. You might be surprised to learn what can happen in this country also.
In civil forfeiture cases, the US Government sues the item of property, not the person; the owner is effectively a third party claimant.
WTF?? I didn't know you could sue an inanimate object, lawl

shit, mother ****ers today just dont understand REALITY. if you run from a cop, you gonna get screwed in some way shape or form. your LUCKY just to be shot by a cop instead of beaten. look at other countries where they beat people to death on the streets. people in other countries are scared of the police, and for good reason. people here just think they can get away with everything.

On a side not about running from the cops.... It was about 3 weeks ago that the sister of a former osftball player i coached was a passenger of a car where the idiot tried to run from thecops. he flipped the car, she was ejected and now she is dead. A shame.

By the way, if you run from a cop it is a FELONY. So that little speeding ticket that you would just get a fine and a few points on your license will become some serious crap for nothing other than bad judgment.

just a little FYI. Enjoy:

There are two types of forfeiture cases, criminal and civil. Almost all forfeiture cases practiced today are civil. In civil forfeiture cases, the US Government sues the item of property, not the person; the owner is effectively a third party claimant. Once the government establishes probable cause that the property is subject to forfeiture, the owner must prove on a "preponderance of the evidence" that it is not. The owner need not be judged guilty of any crime. In contrast, criminal forfeiture is usually carried out in a sentence following a conviction and is a punitive act against the offender. Since the government can choose the type of case, a civil case is almost always chosen. The costs of such cases is high for the owner, usually totaling around $10,000 and can take up to three years.

The United States Marshals Service is responsible for managing and disposing of properties seized and forfeited by Department of Justice agencies. It currently manages around $1 billion worth of property. The United States Treasury Department is responsible for managing and disposing of properties seized by Treasury agencies. The goal of both programs is to maximize the net return from seized property by selling at auctions and to the private sector and then using the property and proceeds for law enforcement purposes.
