Since this is such a good idea we should probably expand this policy to include the use of deadly force against anyone seen committing any crime.
And that is the slippery slope my line of reasoning would ultimately lead to.

Sometimes logic is blinded by personal bias against theft.

You argue it is a replacement cost issue. I argue that the effects of theft run much deeper than that. I haven't been broken into at home (knock on wood) but I purchased an electronic survellience system, and I wake up periodically during the night to check on my truck. In essense, the fact that other people's vehicles have been broken into still causes undue problems for me, as well as the rest of society.

 
I'm not saying I agree or disagree with it. All I am saying is that if the supreme court listens to the case and passes judgement, that will be the law.We can debate it for the rest of the evening, but they make the laws (not some people on a car audio forum)

They want some DEEBEEZ, they come here, we want the law, we go see them :p
Not everyone likes the idea of judicial activism becoming a mechanism to make laws. It's kinda circumventing the system.

No i would posit that it would actually increase because people would abuse it by killing anyone who bothered them and society would sink into decay.

Works in other countries. Now, I know they don't use deadly force for everything but public hangings, hands being cut off public beatings etc.
If its such a great system why don't you move to a place like that?

Maybe you would feel more secure and safe living in Iran.

Also i would like to point out that you are placing the value of a good nights sleep at less than the cost of carrying decent insurance on your truck; why i am not sure.

I am arguing that the value of his life is less because of his actions negative effects on society.

Or do you feel all the members of a given society have equal value?

That opens the door for a lot of discrepancies. Licensing all citizens with the ability to enforce capital punishment opens the door for a lot of death. "I'm sorry judge, but I noticed he was plagiarizing. I had to shoot his ***."

Of course i know the tactic, that's why i wouldn't let you get away with it.
