Should that quote say "the house"...the report sounds like the thugs were in a neighbors house not his like that sentence depicts. Defense of property does not apply here so its murder. However, (assuming the neighbors were home) his defense is that he felt their lives were in danger via a dangerous felony, (and that the thugs would use deadly force) thus he shot them...but it wont work.

Hmm... well I certainly would like to think if my house was being robbed, my neighbor saw it, and had a chance to stop them that he would do it.

A friend of mine had his house robbed -- guess what the law did? Nothing. Worse than nothing... they brought in a suspect TWICE. Let him post bail BOTH times. He skipped town both times -- haven't found him again yet.

If the guy didn't shoot the robbers they would likely never have been caught. Hell, in our society they probably would have sued the home-owners they robbed for stubbing their toe on the way out.

Interesting question about where to draw the line about "vigilantism" -- in this case the dudes neighbor was being robbed, based on what he said on the tape they approached him when he came outside, that makes for a better case in our system.

If you shot them in the legs you would probably end up in an endless legal battle with them over pain and suffering -- remember, this is America, even if you are in the process of committing a crime you can still sue for injury. It has precedence in our legal system.

i don't really think that there is a social contract between anyone. just some people are racist and some people aren't

so theoretically if an abolishment so happened to occur that would end this "social contract", nothing would happen due to the fact not many people know of it. and also you can't abolish a social contract even if there was one.. you could only partially abolish it because not everyone is going to have the same thoughts

ok, maybe he shouldn't of shot them, but u know the police are going to take they're sweet azz time getting there. also, all the perps are going to get is a slap on the hand. what the hell is that going to teach anyone. nothing IMHO. if it was me, i probably woulda held em at gunpoint, possibly put them under citizens arrest. however, i have no clue how that work. but u know, if this guy didn't do anything about it, his neighbor would never see his stuff again.

I dont think you understand the concept of social contract theory. Google 'social contract' it and get back to me.

True, but how was the guy to know the cops wouldn't take all day to get there? All too common that response time is abysmal. Sure, if he knew 100% they would be there almost immediately I can see holding off on shooting -- but hell, I agree with the guy... it's messed up that people get away with that kind of thing every day.
