Need legal help...alcohol related offense

This past weekend was block party up here at bloom u. if u dont know what it is, its like mardi gras. the entire town getts hammered all weekend and make a huge mess and shit. anyways, my friend shnozz came up for block party. hes 22 and im 21. we were hanging out front of SIO's porch (Sigma Iota Omega), and a cop rolled up. i put my beer down, shnozz held his. and the cop gave him a citation for an open container in public. shnozz was on the cement steps leading to SIOs porch, so i think it wasnt technically a public area. but aside from that, we are trying to figure out what the consequences are. the cop said it wouldnt affect his license, but a lawyer shnozz knows said it could. and so did the DA's secratary. the reason shnozz cares so much is cause he just got a job driving for the state, and if it affects his license, he could lose his job. i been looking everywhere online for info on this, but cant find much. any1 know where to find the PA laws on open containers in public?

I would search for another forum, I am sure there are ones that are much better that can really help you out a lot more.

PS you have shitty cops

During our block party, they shut down a mile or so of street and you can drink anywhere but literally *ON* the street, sidewalks are fine, so is being anything but under 18 years old, unless you are doing stupid stuff, they dont even care.

 
if the property was private property then they cant do shit about it. its like at the beach you cant drink at some hotels and others you can. the last hotel i stayed at we could drink in the parking lot (well legally i couldnt) but if one of my buddies that was drinking stepped onto the side walk then they could get arrested. the parking lot or balcony's didnt matter b/c the hotel was privately owned. but the hotel across the street wasnt privately owned and people were getting arrested for drinking on the balcony and in the parking lot. that should be the same case with your situation tho.

i dont see how you can get a ticket for drinking a beer in front of your residence?
yes its owned by the frat. but the cop said it was public property. i think he could win it, but it might not be worth the gas itd take him to get up here ya know.

thats usually how it is here, but i think this cop just wanted to be a dick. there was a photographer with him from the local paper, and she took like 100 pictures of us...maybe he was showing off..
