YUP. ANY WAY THE COP CAN ALWAYS LIE (sry for caps) and tell the judge he smelled a faint oder or pot. and there is your probal cause. just pay the fine man. i know it sucks but do it and get it over with. And remember :It's not illeagle unless you get caught:

Suspecting underage drinking is not probable cause unless they know for sure the people in the house were underage and drinking.

Only way for them to know that is to card everyone in the house which they could not have done since you did not give them permission.

However in the past when I was underage we did have cops who tried to search the house and we told them no so they waited outside for anyone to leave....there were people passed out anywhere and everywhere b/c nobody wanted to take the chance of leaving...lol

 
best advice i ever recieved from any lawyer was... if a cop or anyone comes to your door.... Open it slightly and slip outside so they cant see in then lock the door behind you. talk to them outside and dont ever give them permission to enter your home... If your guilty of something or not doesnt matter dont ever let them inside. they will get pissy and threaten but 99% of the time they wont waste hours getting a warrant to search the house and if they have no cause they are liable to be sued big time... in the future be quiet when you drink... and keep loud assholes away from your place... or dont drink while under age... if they were big assholes they would of taken the 21+ to jail and charged them with contributing.

suspecting is probable...

i doubt they would sit outside your home to wait for people to come out since that would be harrassment and waste lots of time they would be spending doing other shit...

Exigent circumstance trump the Search Warrant requirement.

Kids pouring out Alcohol is destruction of Evidence, therefore entrance is permitted to prevent said destruction, yo.

If they reasonably believe there are underage persons in the home consuming alcohol; At a minimum, LE would have the right to seize the residence and said occupants for application of a Search Warrant (which could/would include entry (not a search). Then, anything in plain view during the Seizure to prevent evidence destruction would be enforceable/admitted at trial.

It's all based on what a Reasonable Person would think. If a Reasonable person were to see whatever those Officers that night saw, and believed that there was a crime occurring; then there ya go.

one thing everyone forgets is that laws are different state to state.

In FL they have to have a warrant or permission to enter your home. If suspecting is probable cause then no warrant would ever be needed in any crime because the cops could search where ever they wanted based on suspecting.

Same about cars, they can ask to search your car. If you say no they have to get a warrant.

Eeeer no.

Motor Vehicle Exception.

Because a Vehicle is mobile, it has an exception to the Search Warrant requirement when Probable Cause is established.

Hawaii is the only exception to that rule.
