Legal advice, please...

Agreed with all those who said walk away...

I do not think the police will bother with a $100 issue.

The only thing I think he might do is say you stole stuff (your own stuff) from his shop...But then he would have to explain why he had it and such....I would tell him to take a hike, call his lawyer if necessary.

wait? it boggles my mind why an employeer would cry like a whinning ****** for 100 dollars? I mean, with all the effort thats already put into this...his time i am sure if worth way more than that. and if not //content.invisioncic.com/y282845/emoticons/*******.gif.a649d21efc0d1fd4890a6428166586c1.gif go ******** and forget about it. Stupid management skills if you ask me; have to know when to just let things go //content.invisioncic.com/y282845/emoticons/rolleyes.gif.c1fef805e9d1464d377451cd5bc18bfb.gif

I just spoke with him, he returned my call. We talked civil-ly (sp?) and he kept using the word "agreement" and the name of the business (not his name) and tried to get me agree to "our agreement".

I never stated that I "agreed"... seemed like he was trying to record the conversation.

Anyways, we came to common ground it seems. I offered to sell some old stock on ebay/craigslist... and any profit would go towards the supposed "$100 owed." He agreed to this.

Are you going to send me 30 more messages on live? //content.invisioncic.com/y282845/emoticons/crazy.gif.c13912c32de98515d3142759a824dae7.gif
Possibly, you never answer ***.

From reading the first post it sounds as if he already went and got everything from the previous employer, which is why the phone calls and threats are now occuring.
Truth.

Why did you agree to give me anything? That seems like a confession, of sorts. Not saying you did anything wrong, but it appears to be an admission of guilt or wrongdoing.

Although from your perspective, I believe you "came to an understanding" so he would leave you the hell alone.

Truth. It was just to get him off my back, and to delay things even further.

I'll draw it out as long as possible.

that employer is a bad employer........

1 he had no leg to stand on,**** him.

2 paying under the table for any amount of time is illeagal

3 if something gets stolen or wrecked at his place of business its his responsibility not yours

4 if you are a suspect he should have fired you alot sooner

5 he wont call a laywer its too expensive and he is just threating you

6 call his bluff, then threat him youll call the IRS for under the table payroll

if it were me Id ignore him and look for better work, they sound like a bunch

of amature kids running some stereo shop

I've already found a new job.

Been there for a week now, better pay, better environment, full benefits, room for advancement, and tuition reimbursement.

Let him call the police. Technically you arent responsible for anything that happens there. You were being payed under the table so you werent on payroll and arent covered by the shops insurance so you shouldnt pay shit.
HERE.

If what you took is yours then I don't see how any theft charges will stick. They can't discipline you, hold your equipment as collateral because you weren't an employee. I could see him trying to pin the theft from the car on you, but honestly how is it going to stick. He should have called the cops right when it happened if he wanted to go that route.

Call a labor lawyer and do an initial consult to get a REAL experts opinion though.
