got rear ended and got screwed

so last night one of my friends and I were driving to menards in my car and this guy was just on my *** so I tap the brakes a little bit telling him to back off so then he tries to pass me on the right in one of those lanes where you pass when someone is turning left but he doesn't get passed. so he is even more pissed and gets closer I do the same thing again tap the brakes, so then he tries to pass me on the right and I don't let him pass. so he gets back behind me and is //content.invisioncic.com/y282845/emoticons/mad.gif.c18f003ab0ef8a0d9c27ca78d77a6392.gif and then I get on the brakes but not hard I just start slowing down then out of the corner of my eye I thought I saw a deer so I put the brakes on some more then he taps my rear bumper. Well then we pull over and he comes back to my car and yells "WHAT THE **** ARE YOU DOING!!!" then walks around my car and back to his car so we call the cops. They come, cop come up to my car and said what happened so I told him the story and blah blah blah, cop says "you didn't see no deer did you." I told him I thought I saw one because there is a snowmobile trail right next to the highway and then there was a car vs deer collision right up the road. But the cop never beleived me and I bet if I was 25, 30 years old he would've beleived me. Just from reading what you wrote, if you gave that cop that same story you might as well forget the attorney and pay the fine. No judge in there right mind is going to overturn that after what you told him. There is also a law about tapping brakes and all that good stuff but I cant remeber the code section. no there really was no damage because by the time he hit me we were doing about 5-10mph. but why wouldn't it still be his fault and no I didn't tell the cop what I told here, I told him a shortened more better sounding story.

Now how much did you leave out on your end of the story as well. Because it seems he was trying to pass you and you wouldnt let him. I mean how slow were you going and if hes that pissed and your going the speed limit etc and he wants to pass you he should have no problem hitting the gas and getting right by you. I mean how much were you really fukn with him. People do that sht to me all the time here going really slow I come up behind them doing the speed limit or 5-10mph over and slow down. And they just stay slow and then slow down even more to well below the speed limit and dont let you pass etc. I hate to say it but my temper driving isnt that good with people like this. In this area on the way back from syracuse there are 2 spots to pass in about 20 miles. 55 mph zone. I do 60 or so got caught up to a car that was doing about 20 couldnt pass him got stuck behind him for at least 25+min and then once I reach town to get in other lanes he kept cutting in front of me. All through town and I wasnt being a dick about it. Finaly at a stop sign he sat there and would not move I waited about 3 min. Finaly I got out of the car and went to his turns out it was a friend stoned just fukn with me but i was honestly ready to kick the sht out of him over that.

unless you are ommitting something major in this story so you don't look like a moron and get flamed, court will be your friend and you should pwn this guy. In the future, just get out of the way and let him go away- it's better to avoid confrontation altogether then end up like you did.

the only exterior mod is I cut open my turn signals and took the amber pieces out, then sealed them back together. I got intake, header, clutch, and 12.5lb flywheel. no ricey exhaust.

and no I'm not omitting anything big in the story

I was in the same situation on the freeway. Guy cut me off, so I get in front of him and slam on my breaks. He passes me and does the same thing. I tap his car while pulling over to the emergency lane. As soon as he jumped out of his car running up to mine, I knew he wanted to start some stupid chit. Only took one straight hit to the jaw. It was over and I drove off. I got lucky on that one.

Road rage is pretty stupid and you could end up getting fuked. Dude I hit could have had a weapon and I would have been screwed...

Just take it to court.

Well i am just lost why you got the tickets then, I mean reality the person that hit you is at fault no matter if you just had a back spas and hit the breaks. But there had to have been something said that showed you were the one at fault and driving poorly.

Here's an exception to that general rule, dB: I used to drive a cab. One night I was working.....driving in a 55mph zone doing about the posted limit. I was coming up on a 4-way intersection and saw another car approaching the intersection from the road perpindicular to the one I was on. The driver did everything properly - came to a complete stop at the red light, had her turn signal on to alert anyone in front or in rear of her of the intent to turn, blah blah blah. She made her turn and was in the outside lane of the road I was traveling on so I moved into the inside lane (I'm still going 55mph and she had just made a right-hand turn) When I'm less than 15 yards from her she decides to change lanes right in front of me 'cause she THOUGHT I was in the other lane and she wanted to get out of my way ~ and got IN my way instead.
Well, since I was doing 55 and she was doing less than 10 having just made a right turn at the light then changed lanes immediately all of a sudden I find myself closing the distance between my front bumper and her rear bumper really, really quickly. I slammed on the brakes and all 4 of them locked up ('90 Caprice Classic with no ABS was my cab) and I slid into the back of her car pretty freggin' hard. Because I had rear-ended her I just KNEW that the accident was going to be written as my fault.

I got incredibly lucky that the lady was honest and told the cops that she had changed lanes right in front of me and due to the varying speeds our vehicles were moving at that I had nowhere to go BUT into the back of her car as a result of her lane change.

In most states it is generally accepted that if a person gets hit from behind that the person who collided with the back of a vehicle is to blame. If there is a question of the person who gets rear-ended operating their vehicle in an unsafe or antagonistic manner, however, that doesn't always hold true. If you told the cop the same preceding story that you've related to us prior to making the claims about the deer you just might get the bad end of this deal. I won't say you're at fault for being angry about this guy riding your bumper but there was certainly some less dangerous avenues that could have been followed in an attempt to handle it.
