Ebay problem, I need advice.

I purchased a card encased (slabbed) by hard plastic.

The hard plastic has damage on it...not drastic...but its noticeable

Anyway, I told the guy whom I bought it from that it is damaged, and he told me that it was insured. I went t the post office and they said that there was nothing wrong with the packaging and they could not do anything about it.

I told the guy what the post office told me and he basically said it wasnt his problem. He says that he didnt ship it damaged (but I dont believe that it was damaged during shipping)

what should I do?

thanks in advance

If you filed with paypal, go that route. And not to be stupid, but what are you talking about, that your purchased?

You could file a complaint with ebay as well. Just say the item is damaged, and that the post office says it was not their fault, and you'd like something done.

Don't be a dick, not that you would. Just state what you want, and what both sides have said.

Thank you. We'll let you know by email when the seller responds.

You'll be able to review the seller's response, post new messages to the seller, and track this dispute in the Resolution Center.

Dispute Timeline

You and the seller have 20 calendar days to resolve this dispute. Your dispute will automatically close on Jun. 10, 2007 unless you or the seller escalate it to a PayPal claim.

By escalating to a claim, you would be asking PayPal to review the dispute and decide the outcome. We will email you a reminder when the deadline is approaching. Once a dispute is closed, it cannot be re-opened or escalated to a claim.

After almost a month of back and forth emails......he now tells me that I could get the card replaced (after reporting him to ebay).

I dont want to be an ***...but...I dont want the card anymore. I just want my money. I dont want to deal with him. It takes a complaint for him to do something about the situation?

Am I wrong to ask for my money back?

No, your not wrong. If depends on what you would like more. 1) You want the card, so you put up with him a little longer, and hopefully get the product you want. 2) It's not worth it in your eyes to deal with him any longer, and you ask for your money back.

His reply:

so send it back to us for a replacement

My reply:

I do not understand why you now decide to offer me a replacement after several emails. It seems to me that you only took action due to the fact that I reported you to ebay.

I do not want another card, I just want my refund.

his reply:

it cost 5.00 to reholder the card send it back for replacement

My reply:

This has been an unpleasant experience for me. We couldve settled this before I reported this to ebay. All I want is my refund. I have no interest in the card, sorry.

Hope you can understand.

Thanks
