Ebay problem, I need advice.

I bought this card Apr-24-07

as soon as I received the card I reported it (I received it May 2nd)

I bought the same card from another buyer (Apr-29-07)

here is what he's saying:

"check his bid history he won the same card for less money now he wants a refund on ours, we will replace the card but will not give refund . this is like buying stock and wanting to return it when it goes down"

then he escalated the claim before I could reply to paypal

Hmm. Explain the situation, saying the seller was unpleasant to deal with, and did not want to offer a replacement. Since you found another card, you went to get it.

Email I sent paypal (Im very pissed...so I messed up with my writing):

Seller escalated the situtaion before I could reply.

I purchased another card from another seller on Apr-29-07. I have a few doubles in my collection, it is not uncommon for me to buy same cards (as you can see in my history I have bought doubles before). The difference between his card and the card I bought is only $12. I do not understand why he assumes that Im trying to hustle him. The problem I have is that as soon as I receieved the seller's card (on May 2nd) I reported the damages. After 3 emails (I have the proof) all he said to me was that he wasn't responsible. Then after I reported him to paypal, he decided to assist me. I personally do not want to do business with him. He is a very bad seller. All I want is my refund, I am a very reputable Ebayer and I would never try to scam anyone.
