Do we have any legal options?

im confused on what to do about this so hoping someone here has a idea..

last night my wifes father died of cancer @ age 50

he was diagnosed about 4 years ago and thought they got it somewhat contained but within the last 4 months it quickly spread to his chest and liver and passed last night

well anyway he was dating a girl for around a year and a half. they were married a few months ago. from the begining we were skeptical because she was well aware he wasnt going to win this battle but claimed that the church would frown on them both for not getting married, and after a while he gave in and were married a few months ago.

since he passed last night all hell has went through the roof in the family. he was set to make his will later this week but didnt get it done so by law it all goes to the wife, however they have a partial will concerning property and misc items that were suppose to be given to family and nothing to her. the will wasnt completed or signed so were unsure if it can be used if we need legal action

earlier this morning the wife found out that he made my his daughter(my wife) the beneficiary on his life insurance and she fawking lost it and stormed off to her aunts house which right away sent alot of red flags through our heads, from the start we thought she was in it for money and we kinda think its coming true.

are we able to take legal action against her to gain back his possesions or are we wasting our time?

 
You can try, but there's nothing you can really do.

Law states that if no will is written and signed with witnesses that all property is thereby held and given to the wife.

If his will was written completely and signed, no big deal as you know, but seeing as it's not - there's not much you can do.

Irregardless as to how much we tell you on here, NOTHING is going to work out better than sitting down for a solid consultation with a lawyer. Hell if you have to, get in touch with one of the lawyers that only gets payed if you win the lawsuit - get their opinions, find out.

thats a good idea, our minds are so fawked right now we didnt even consider those type of lawyers

 
if she isn't home then go over there and get the stuff you wanted and were told you could have
my wife was there today and took alot of stuff from when she was a kid. the one that bothered her most was a pistol thats been in her family forever and has no value, and she refused to let her take it with her. we think its resentment after finding out my wife was sole life insurance beneficiary

 
There has to be something there. We had a similar situation, and found papers deep in a closet from where my dad already had left my brother I possesions but not his ex wife (Our mom) go figure.

I hope you get this sorted out and sorry to hear about the death.

It's always a good reference point. Start there(or if you can get a free consultation with a good lawyer, you can do that as well) and then go to another one if you don't think they've worked hard enough.

Free opinions never hurt anyone and never will bro. Get as many expert opinions as you can get.

The first thing I would've done was contacted a lawyer. They have hundreds who specialize in settling estates. I would've never thought to ask on caraudio.com. Why on earth would you ask here?

My comment was more to suggest you are too stupid to handle an inheritance.

 
No matter what the **** ANYONE tells you it comes down to the SPECIFIC lawyer and what trick they have up their sleeve.

Your situation is sooooo specific that everyones opinion has no relevence.

In these situations you always TRY

Asking advice like this on a car audio forum HAHAAH.. what if people told you to not bother.. would you go back to yer family fighting and screaming to let it go hahaha..
