well... that would just be illegal //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gifI had a similar situation with my car... only with much less damage. If the damage is more than the car is worth, they will reposess your car and give you it's estimated value. I really had to fight hard to keep my car, since you absolutely cannot find a car for $1800 that is in better shape than this one.
They dont "reposess" your car, its YOUR car, in your name, your insurance company cant just take it.
I was going through the same situation with one of my camaros, they dont just "take" your car though, they give you the choice to either take what they are giving you for the car (blue book value) or just keep the car and get no money out of it, witch thats what i did.
They called it totalled, just becuase it needed a new radiatior support, new a arm on the right, and a new bumper and front spoiler, calling a 92 RS with 72,000 miles on it totalled and only wanting to give me $4,800 for it, i dont think so.
If you do go the other way though, they pay you bluebook value, then you have to buy the car back from them from whatever set price they have, useing the money they just gave you for the car, THEN if its totalled you have to get it fixed, or put all back to stock, witch is very stricked, no rims or anything of the sort, to get a salvage or reconstructed title, witch also costs lots of money to do the whole process, also, your going to have a nice RC or S on your title, whenever you sell your car, youll have a fun time explaining that one..
I work at a garage and just got done doing one of these for somebody, they spend over $8,000 fixing and getting their car back to stock, i had to inspect it, take pictures, and send them away to get them looked at, turns out it failed becuase it had bigger then stock tailpipes, now he has to start all over again, the process takes about 9 months... you can not drive the car during this time.
But, your just getting a new car, and i wrote all this for nothing basicly.
