hey guys, didnt get a chance to read all of the replies since Im at work.
But regarding how much I had, I had probably about 10-12 grams of weed, it was 2 1/4 bags and both have been picked from a little so they would be a little short. The E I had 7 pills.
I didnt eat or even hide the shit better because it was at a ride check and I thought I would get through fine, the cop walked up to my window, thought my eyes were red and pulled me out of the car right then and there.
When I go to this first appearance thing, do I have to try and go super early or something and try and talk with someone to work out a deal? Or do I just wait for my name to be called in court and see what happens?
I have zero problem saying guilty to anything that would keep me out of jail, the pellet gun is bullshit but it does look pretty real, but it was in the back of the car under the rear seat unloaded, the weed was mine, and the E "wasnt mine" is what im sticking with.......
need some advice
As stated before your first appereance is just to do one of 3 things:
1) say that you are hiring an attorney, you will have to sign a waver for a public defender. normally you have 30 days to still get a public defender if you can not get a lawyer.
2) apply for a public defender
3) plead guilty ( DO NOT DO THIS )
You will not need to get there early, in fact you will probably not talk to the DA at all. There will most likely be a decent amount of people in there and they do not want to talk to everyone nor do they have time. If you do have questions though, ask them.
You do not necessarily need an attorney present for your first appearance but I highly suggest getting one soon. You will not want to go through all of this without any knowledge of the court system and most good lawyers will have connections within the court system.
At the first appearance they will give you another court date, on that date you will definitly want an attorny but hopefully before the your attorney will have worked out a deal for you.
Like others have said the drug charges will depend on your state but the weapons charge should be dropped. It will make a difference though if you told the officer about it or if he had to find it. If you did not tell the officer then you should tell them that you forgot it was in there from a few weeks ago and make up a good story.
For now, find a lawyer, stay out of trouble, get your story straight with your friend in case they question him, and dont let it get to you. The court system is extremely slow in most places. Hang in there!
