Dood, that's like me sending a mafia buddy to collect money that you owe me. You wouldn't be upset about someone roughing you up over a debt that isn't even owed to him? The collection agency doesn't legally own his debt, you know how you can tell?

You see that part in bold? Yeah that's right, it's not valid until it isn't disputed, ie, they're using common law defaults to create a debt that isn't theirs. But that's besides the point. The point is, you do research before you start handing money to people claiming to be debt collectors. Especially ones that treat you like dog shit.

The recording of the phone conversation is only there to make sure the collection agency abides by the rules and protects both parties.

Anyways, she has no right to treat him like that until the debt is legally hers, which it isn't, because he hasn't received written notice after contact, which is required by law. On top of that, he has the right to request proof via the original contract he signed and the ledgers on the account.

The debt collector is probably making a 600% profit off this whole deal anyways, I don't see why you think it is immoral to exercise your rights against a company that does it's business by scaring and harassing people who are short on funds.

Depends....it's a state to state issue on what debt collectors can and cannot do.

 
I actually agree with Cheese here...
a) I would have told got equally as rude with her. If you have nothing, they can't take anything

b) Make them find the paperwork. People are also using this as a way to get out of mortgages. Say your loan has been syndicated 5 times, rolled into a MBS, etc...no one knows where the actual loan you signed is. They have to be able to find it. If you are in deliquency, it is a good way to buy some time.

I guess this should be explained more clearly, as many people forget this.

When a bank loans money, there is a reason why we pay interest beyond opportunity and federal funds rate. It is called risk. The interest pays the bank for assuming this risk. If you are a more risky borrower, you pay a higher interest rate.

If you don't pay...the bank loses money. When they take a risk, sometime they chose poorly.

For some reasons, many people think that it should be their first priority to paying off this debt or that owing money is somehow meaningful or something. It amazes me. You think Donald Trump worries about paying off loans? Not really as he has declared bankruptcy numerous times from RISKY ventures that didn't pan out.

You don't have to pay. I'd consider it the banks loss for assuming the risk.

Well...if it had only been a couple months ago, ya ok I would have not even let it bother me one bit. but 2 years later, they want to call out of the blue?

It's not rude. It is a business decision. If people can't handle modern finance, perhaps they should pick less confrontational businesses like carrot picking.

 
Well that and not everyone has a job to where they got extra money to spend, I made $400 every two weeks, that was for truck payment, insurance and gas back and forth to my last job.
I had gotten the credit card when I was working for my amp helping install control panels and conveyor belts for some good *** money, then that went all to hell and was stuck with no money to pay bills, like what has happened to me again! Can't help it when you get laid off from your job:)
When being layed off is a possibility (which it almost always is)... You don't spend more than you can afford to pay... Which applies to every day life... Irrelevant of your job situation...

I do. Hell, I hope to remain in debt forever and ever. I have no issue with it.
