I think like the question and would love to hear a more educated answer than mine...but my guess would be that if he's pulling you over for that specifically, he can cite that he saw the tint. Even if you don't have to put them up for him, if you want to fight it, they'll say, ok put up your windows to prove they're legal. Just my guess though. So, if you have illegal tint, and get pulled over... If you have your fronts rolled down before the officer gets up to your vehicle, and he asks you to roll up your windows, could use the 5th amendment and decline their request?
Usually, (as far as what I have heard), cops wont pull over for tint alone. So the tint would be out of site, out of mind. Or, say they did pull you over for it, or they ask to see because they had noticed dark tint, you could have your windows down when they got up there anyway. Which, using the 5th, I would think it would protect you from having to roll up the windows, and if he doesn't test, he has no proof, and therefore would not hold up in court. But I am not sure if the 5th amendment would cover an action that could be self-incriminating.I think like the question and would love to hear a more educated answer than mine...but my guess would be that if he's pulling you over for that specifically, he can cite that he saw the tint. Self-incriminating? So when they ask to see your glove compartment for no reason and you say no that self-incriminating??? haha Nah j/k But yeah I agree with what you said except don't they and can't they just pull you over for tint alone? I have a cop that sits right in my town facing the road and I know if I drove past looking like I do in my car, he'd pull me over for just the tint.Usually, (as far as what I have heard), cops wont pull over for tint alone. For the glove compartment, as far as I know (which isn't too much), they have to have reasonable suspicion to request to look into the glove box, or search anywhere else in the car. While many cops abuse this, if there is absolutely no suspicion, they technically could not make you open the glove box. They could ask you, but you would not have to without a warrant, unless they claim and properly state what is suspicious, and demand that you open it. Its a sketchy situation, and hard to find a definitive answer.Self-incriminating? Yup! And then they can haul your *** to jail for not cooperating with the law, or if they feel like it, they can remove you from the vehicle and roll them up on their own.So, if you have illegal tint, and get pulled over... Yeah people argue on both sides and I can easily see both (not talking tint lol) but it comes down to this:Yup! And then they can haul your *** to jail for not cooperating with the law, or if they feel like it, they can remove you from the vehicle and roll them up on their own.
Depends on what mood they're in. You should try it.
i get away with too much shit too. lol, blue halos in the head lights which are clealy visible. smoked license plate cover, smoked tail lights.get 20% and call it a day.
i get away with mine all the time. i currently have a few illegal things on my truck:
blue license plate bulbs
smoked plate covers front and back
20% tint
They're police. That is their job.Yeah people argue on both sides and I can easily see both (not talking tint lol) but it comes down to this:
A cop will do whatever a cop wants to do. Some will do as they are supposed to and follow procedure. Others will f with you just because they have a little bit of authority and they decide to use it, plus more of which they don't have. Nothing is going to stop them from doing anything when it's you and him on the side of the road...period.
I have heard that seatbelt thing, but I know that they can pull over for just a seatbelt, it can and does happen, and there is no law against it either, you are doing something illegal, and they can pull you over for it. But it depends on the cop and how their day is going, as with anything. I always wear my seatbelt, so I never have to worry about it.i get away with too much shit too. lol, blue halos in the head lights which are clealy visible. smoked license plate cover, smoked tail lights.
iirc they can't just pull you over for tint. it's like your seatbelt. well in florida that is. it is against the law to not wear it, but they can't pull you over for it unless if you either did something wrong, or if there is a click-it-or-ticket campaign time period or something of that nature.
