you are referring to a CRIMINAL charge. this is Civil - same rules do not apply. does not go on record. it's what Chris Rock calls a "jack"

If it is a civil matter what contract is in dispute? I though civil case were matters involving failure to perform a contractual obligation or causing damage?

With no contract and no damaged party to bear witness, if the whole thing wasn't just a shakedown, this sort of thing would not have legs in a real first world society.

The only difference between this, and if you're a tourist in Tijuanna being shaken down by a crooked cop on a streetcorner is the fancy robes and suits in the "courtroom"

the State of Iowa backs this up. Arguing the "U.S. Constitution" would be pointless, states are sovereign.

I believe the civil war proved that not true. State of Iowa needs to perhaps look at cutting spending instead of putting in random 100$ toll machines to fleece citizens.

Considering the perferated condition of stop signs up in Maine, I don't think cameras woud fly to far up there.

Seriously though. Great read, and this so far has been the most interesting thread in forever. There are many officers who feel like they have power and authority and utilize it to demean regular citizens.

As an Acoustics Engineer - I take measurements and analyze data for the purpose of noise ordinance evaluation.
I could have ANY noise measurement done by law enforcement invalidated. I know how hard it is to take an accurate measurement. They are not capable, do not record enough ambient data, and do not understand acoustics.

 

Simply put, no dB meter is capable of determining the location of a source or it's amplitude. dB meters measure everything, and everything adds logarithmically.

 

So a dB meter is incapable of differentiating your car's contribution to the overall noise level at the time of the measurement.

 

In addition, you must record ambient temperature, humidity, and wind speed at the time of the measurement, as well as an in-situ calibration before and after.

 

Also note, that reflections off buildings, the ground, cars, etc. will exaggerate the source level by adding to the overall level.

 

No dB meter is capable of determining the source level of a vehicle, that requires time-consuming and extensive calculations, provided the exact situation and variables are properly documented.
I literally just typed and printed this out to be laminated and hung from my rearview. You sir, are my hero. May I ask where you attended school?

 
finally, after moving through all three witnesses, and having each one verify my evidence was valid before i pointed out that it meant the speed was 48 MPH... i got to talk.
ya'll don't know me... but i like to talk. i can talk for 5-10 minutes straight, no pauses, no stutters, no slips, and speak coherently and formulate intelligent thoughts, prove points, and convince anyone of just about anything.

at each of these points, the prosecution sighed in agreement:

1. i explained that the radar is inadmissible since we have no photo or proof it was aimed at my car.

2. i explained that the time and speed are calculated using inaccurate math (rounding errors)

3. i explained that the only useful variables are the distance in the photos and the time elapsed in the video.

4. i explained that i learned how to analyze video to calc speed by reading law enforcement papers on training officers for calculating speed of a vehicle with a video (i.e. dash cams or security cams or these traffic cams)

when asked my profession: Electrical Engineer and Acoustics Engineer

prosecution sighed.

when asked my degree: Bachelors of Science in Electrical Engineering

prosecution sighed.
