SO that part in the US Constitution that guarantees a right to trial by jury and a right to face one's accusor is gone?

Seems that having to PAY to have rights and not need any actual witness is pretty tyrranical.

Parasites like that are the reason Jefferson, Franklin, Adams, etc. wrote in the second ammendment to the constitution.

you are referring to a CRIMINAL charge. this is Civil - same rules do not apply. does not go on record. it's what Chris Rock calls a "jack"

As an Acoustics Engineer - I take measurements and analyze data for the purpose of noise ordinance evaluation.

I could have ANY noise measurement done by law enforcement invalidated. I know how hard it is to take an accurate measurement. They are not capable, do not record enough ambient data, and do not understand acoustics.

Simply put, no dB meter is capable of determining the location of a source or it's amplitude. dB meters measure everything, and everything adds logarithmically.

So a dB meter is incapable of differentiating your car's contribution to the overall noise level at the time of the measurement.

In addition, you must record ambient temperature, humidity, and wind speed at the time of the measurement, as well as an in-situ calibration before and after.

Also note, that reflections off buildings, the ground, cars, etc. will exaggerate the source level by adding to the overall level.

No dB meter is capable of determining the source level of a vehicle, that requires time-consuming and extensive calculations, provided the exact situation and variables are properly documented.

note that my approach was unique to my situation. in order for someone to use this in their own case, they must go through the same calculations and steps I did. they must orchestrate the same defense, in court, though the use of evidence, cross-examination, and testimony. Had the prosecution been more capable, they would have attempted to have my evidence, calculations, and cross-examination thrown out. my purpose was not to invalidate the system or prove it could not issue tickets - but instead to address that the methods used by law enforcement are based on assumptions that are not applicable. i believe the evidence to prove the speed of a vehicle is there, it just needs to be analyzed in the proper manner. the video is the best evidence they have... and they don't use it.

that would be hearsay.

you must first carefully read the ordinance, and understand all of its limitations. You need to use their ordinance against them.

Then you must formulate a defense that is based on sound science - provide documentation in the form of published papers/text/studies that validate your methods.

Then you must be respectful and polite - earn their respect.

Lastly, you need to know the information well and have a good understanding of the science behind your defense.

I will say that the main reason my arguments were accepted is because of my degree and professional experience.
