And again, 16 states have laws stating it is illegal to refuse hiring someone who is 'addicted' to nicotine. And you've yet to address the fact that nobody, NOBODY, refuses to hire based on drug use (the word drug referring to all/any drugs, including politically correct drugs like caffeine). So you keep on with your 'if there is no law saying its illegal, its legal' rhetoric all you want. The point of this this discussion wasn't even if it was illegal, but if its fair.

You simply refuse to answer if you think its FAIR, dont you? If you are going to refuse, at least say so, instead of falling back on 'they test because its illegal'. We already know they dont/cant/wont test for legal drugs, that is not the point of this thread, our discussion, nor is it even interesting or informational.

What you don't understand is that your question implies that marijuana is illegal, but yet you said we're talking about it being legal. That's my point.And let me further explain why this is important. If weed is legal, it would be illegal for me to ask an applicant about their drug use to find out what the extent of their drug use is.

But since you're clearly too dumb to understand that let me just go ahead and answer:

Yes. It's fair to assume that their drug use could effect their work performance.

Lazy, how could you possibly think someone that someone using pot while not at work is going to affect thier work performance? You said you have friends that smoke. You should know the effects only last a couple of hours. How could you think its fair to say thier performance will be affected
