i actually started to post the gay comment in the post above as well. then i noticed i was typing "well im not really sure thats a choice, its a debatable topic, but the gays definitily wil say its not a choice" and going on and on, i realized itll make the post a paragraph long

which is why i nixed it from that post lol

 
i brought up religion as well, thats a choice, but you cant use that as a factor on if you will hire or not...
of course a smoker or anyone else (well i dont know i have never done hard drugs so maybe they cant quit in which case they have a problem) can quit in order to maintain employment. hell i havent smoked for months now, and i always take nice long breaks from it...but that doesnt mean its right to ask someone to piss in a cup for an employer, or have hair plucked out of their head, or give blood, not just to keep their job, but to also get hired. im glad canada at least has some sense in this matter.

Fair enough and I know what you are reaching for but it still doesn't compare. Being of certain religion isn't illegal so companies wouldn't have a leg to stand on by using this for firing without paying unemployment. Additionally there isn't a verifiable higher risk of employing anyone from a certain religion. There is a higher risk of employing drug users. I am not saying they are all lazy slackers either, but their is a high percentage that let it affect their work. the same applies to your GAY scenario.

canada had the same issue (sort of). they ruled it was discriminitory and an invasion

Canada now has some of the strongest protections against workplace drug testing in the world. yet there is 1 particular canadian company who doesnt give a shit and tests anyways despite the rulings. i had the name, but ill look it up later, if you guys actually give a shit lol

 
I'm sure this has been said, but since I dont do drugs and am not enough of an alcoholic to NEED to drink on the job I agree with it. I dont wanna work with people who do drugs and cant wait until after work to drink.

That's the only place where I'd strongly want all kinds of testing. Outside of that, I could care less if the person smoked weed on the weekends.

EXACTLY. You hit the nail on the head.

I'm in charge of hiring at my workplace, and what I do, is I mention that we do a drug test a few floors down (we are in a medical building). Then I watch to see their reaction. We don't even drug test - I just say that.

I had one guy get all scared, and tell me that he smoked weed. I asked if he did anything else, he said no. I told him that honesty is the only way to go in our company, and that as long as he was honest to me (and upper management), that he'd be just fine. We hired him and he's been a great worker. Still with us to this day.

Usually, it's pretty easy to tell when somebody is/was a tweaker. I don't even bother with those types.

I filtered out a lot of the tweekers before they even had a chance to come in for an interview.

How?

Well, I had the employment ad up on craigslist, in which I wrote to send a resume to my email address. I received over 200 applications, online, during the duration of my ad.

Then, I went to myspace, and I started checking peoples myspace pages one by one, using their email addresses.

19 years old and you got a kid? DELETE RESUME

Flamboyant and stupid about drug usage? DELETE RESUME

Lots and lots of retarded drama? DELETE RESUME

Basically, anything retarded, I deleted their resume. Technically, this is illegal, but only if you get caught

I deleted about 75% of the resumes just filtering using myspace... saved me an incredible amount of time...

Kids, remember this when applying for a job.

In situations where it is legal then I have no case really. It would be the same as firing someone who drinks at home. So the real issue here is to get it fully legalized and fight the testing head on. Right now you can't in most respects because you are fighting about something already illegal.
