It isn't the violation of the first amendment. It is a "privately" owned establishment and the owner/management can run it how they see fit. Don't like it? Go elsewhere. Since it isn't government mandated that companies do a drug screen, I see no harm or foul if a company wishes to do so. They are minimizing there chance of getting that person who lets drugs override their lives and lets it affect work.no its a violation of the first amendment. Why should it matter what a productive employee does in their spare time. If the employee isnt productive due to drugs, then why is he working there?
They can't just select individuals. Otherwise to much discrimination finger pointing would be going on. They have to devise a type of lottery draw or other random way of selecting people or simply say everyone.i dont understand how it works though.. like what they just say drug test today and you take it ?? or do they have to have suspicion(sp)???
