Im Da *** Man!!!
ok, so a friend of mine contacted me about a month an a half a go letting me know that he was selling his setup, a 13w7 with box an jl 1000/1. i told him i would buy it but i didnt have the cash. he brought up the fact that he would trade me his setup for mine, 2 massive cw12s box an kicker kx1200.1. i told him sure why the hell not.

at the moment i only had 1 CW bc the the other had the LED light broken off an rattling around inside the cone. i told him i would get it fixed for him an give him the sub when i got the recone. well the whole day i got the sub, i was playin with it tryin to tune it right an it would keep making this popping noise at high volumes. i checked the gain, it was set right. i had the LOUD off on my radio, bass at 0 an LPF set at -8 an when i turned it up to regular listening volume the sub kept popping. so i left it alone for a few days an then took into one of our local shops. i explained to them about the problem an he said it probably had a bad coil. well the manager came out an we took the sub out of the box an he got a DMM an checked the coils. as all know the 13w7 is a dual 1.5VC config. he read the coils an one read 1.3 the other .7. he said that the sub would eventually blow an that it was pretty much a paperweight waiting to happen. after hearing this i contacted my friend an told him that i thought i was jipped on the deal. he in turn told me quote word for word "i dont care, its your sub now, wheres my other sub." i took offense a little an told him that i thought we should return the setups to each other an be done. he said that the deal was final an that he would be waiting for his sub.

well, i took that as a big FVCK YOU an pushed the other sub to the side. i recently sold the amp on craigslist, an ditched the dub7. my friends at circuit city plugged into the wall an we had fun with it. well i kept tellin him that yea i was goin to get it fixed but had no intentions on it. well last week he contacted me about the sub an asked if it was fixed. i told him no. i dropped it off out his house the next day. well a few days ago his dad gets invovled. he is tellin me that i need to make right on the trade an get his sub fixed. i told him that i had every intention on doin so until i found out about the w7. he said i should have contacted them about it if i was unhappy with the trade an we would trade back. i told him that i told his son about the problem an he blew it off an said that it was my problem not his. well his son is denying ever saying that an his dad is demanding i pay for the recone for the massive. if i didnt then he would get his lawyer involved. now i know that this couldnt hold up in court as there was NO contract or written agreement for this trade. only word of mouth.

so basically i am asking, Who is in the wrong?? an what do i do??

i personally believe i was took in the deal an that the recone should be on them not me. if i am wrong please say so.

thanks for any input guys.

Actually, he could get a lawyer involved. Verbal promises are still contracts in a court of law. You could easily win in a court of law if you explained to the judge the scenario exactly as you explained it here. Unless he told you the trade was as-is when you made the deal, then he can't go adding that in later.
I personally would just stay calm and professional and explain to his dad exactly what he did to you. Explain that when you had it checked out, it was messed up, so you tried to trade back and he refused. Even take him to the shop that inspected the coils, or go have that shop sign something as proof. He couldn't possibly be mad about you not following on your end of the deal once it's been proven that the sub was junk.

And as someone said earlier. If he's using a lawyer and not doing it himself, it'll cost more to pay the lawyer than the sub is worth. Although if it was me, I'd send a few affidavits of facts stating how the son intentionally scammed you, that way he HAS to get his lawyer involved, because if he doesn't know how to respond to said affidavits legally, they become facts in a court of law and you will automatically win a default judgement.

That'll cost them money, and regret even threatening the lawyer thing.

Anyways, I'd go with the first option, and just prove the sub was junk, that should solve it.
Yes. You actually did a good job of describing the situation and it is clear to see that you were in the right here. Explain to his dad exactly what happened, and if he chooses to get a lawyer...well some people feel the need to waste a little money now and again, you'll be fine.

Oh yeah... the good 'ol "I'm gonna get a lawyer" bit. //content.invisioncic.com/y282845/emoticons/laugh.gif.48439b2acf2cfca21620f01e7f77d1e4.gif

Tell his dad exactly how it went down, give him the name of the shop if he wants it and if ya have it, the name of the guy that tested the coils. If he still has a problem, and wants to get a lawyer...then call his bluff and tell him to go for it. Chances are he get all pissy but never actually go thru with it since it would cost so much more, for something thats not even a sure win. Then about 6 months from now go slash that motherfuckers tires or some shit.

I would like to meet this 'dad' that threatens kids/young adults legally. The father has ZERO intention of getting a lawyer involved over a few hundred dollar transaction over his son's speaker. He is trying to scare you. And frankly, that's fuccing pathetic of him. Yes Id surely like to meet this dad. Now you know where your 'friend' gets his winning personality from.

Stonewall them, they will go away. You got screwed already, dont let that coward father scare you into getting screwed even harder.
