Apparently he felt comfortable enough to slap his coworker's ***. She wanted it.

That was a relationship gone bad. She was into him. He got into her. they both knew the deal. She was getting serious, he was banging other chicks. She found out. She confronted him. He didnt care. That isn't adequate provocation. Not near enough, especially since he had a way out, or other actions for recourse that hadn't been exhausted.

Convince the judge that his motioning with the folder is the same as finding her in bed with him or that it threatened your life.
