legal question.

i guess if you were there and saw how they were treating me youd see where i was coming from. they were treating me like i WAS a criminal, not just a suspect.

but i guess just like everything else in this country, innocent until proven guilty applies to nothing.

 
Because about 75% of cops are just some punk *** that wants to give people shit. I've ran across nice one's but most of them are just doing the job because they like to be an ******* all the time.

 
they cant search you even if your being arrested. they can pat you down, and if anything feels like a weapon they can remove it. an actually search of the pockets is considered an exploratory search, and anything illegal other than a weapon would be thrown out in court

these cops just took advantage of you not knowing your rights. cops do it all the time. the only thing you can really do now is teach yourself your rights for future run-ins.

laws may vary from state to state, but i dont believe they had "reasonable belief" to search you, your car, or certainly not to detain you.

That what I did, (after I had been ****ed with once or twice) read up on rights and such, the discussed it with my uncle. Between reading and talking to him, I learned how to deal with cops in certain situations.

If he asks you to step out, ask "why? Am I being arrested?"

If they ask to search your car, blatantly say "no". If they say that that gives them probably cause say "bullshit." That line is a complete falacy.

DO NOT give them an inch. 80% of cops are power thriving b*tches. If you give them an inch, they'll take a mile.

 
ok so last night i came home it was around 830-900(it was already dark) and i found that my ex gf was parked in front of my house, so me not wanting to go home went and parked 7 or 8 houses down at a dead end street. well i was there for a while and two cops roll up, first thing that happens was they both turn on their spot lights and shine them in my truck, then they get out and because it wasnt bright enough they then shine flashlights all in my eyes( 2 cops). well they walk up to my truck and the first thing the male cop does was reach his hand threw my window and place his hand on my chest, he then asks what i asked what i was doing here, for my id and where i live. i told him i live right over there on that street and then told him why was there. they then asked me if i was out with my buddies vandalzing houses and stuff and i said no, i came home and saw my ex gf at my house and didnt want to go home or waste gas while driving around. he then goes oo is your gf a big girl, would she pick you up and body slam you or something, i go no, i just dont want to see her, at about that point the lady cop in this ***** voice goes lets go ahead and get him out of the truck. they get me out, search me, put my hands behind my back, didnt put me in cuffs, but they held my hands there, they searched my truck without asking and then went through my cell phone and asked me if i had called all these people lately and i said ya. they then called my mom on my phone and talked to her. they were being complete dicks about stuff the whole time, like the told me to put my hands together and aparantly i didnt do it right so they started yelling at me for it. they also told me that if these guys they picked up earlier turned me in then i would be going to jail, but if i cooperated with them i could go home...

my question is did they have the right to do this, to search my truck and go through my phone without my permission?

What they did was perform an illegal search. They violated your 4th amendment. The only thing they could have done legally was a "weapons pat down" to make sure that you didn't have a weapon immediately available to harm them. For that to be legal though, they have to show a justifiable reason, ie; reasonable suspicion that you may have had a weapon on you.

Going through your phone, through your truck, searching you for contraband was all illegal. You won't win a case in court, but your best bet is to call the department they work at and ask if you can be transferred to the chief of police or sheriff. More than likely they won't answer, but leave a message indicating the officers, time of night or something that would further help the chief/sheriff in identifying what officers did this. Then proceed to say exactly what happened and that you felt your rights were violated. If you really want to hit those pigs hard, go in and file a complaint. Atleast they'll be demoted to riding bicycles around town or doing ***** work for the next few weeks due to their actions.

They can search you, and your immediate surroundings after an arrest.

You're right. If they're arresting you, they secure all contraband from the person and turn it into the facility you're being taken to.

You're immediate surroundings are searched as well, like you said, due to the possibility of you throwing drugs, weapons, etc away in hopes that you won't be caught/charged for them.

Atleast someone else here knows what they're talking about rather than spouting off hearsay and guesses.

 
Dont get me wrong, I work with cops day in and day out, but all of the people talking about how 80%/75% or whatere of cops are assholes are wrong...

many cops are assholes, but its about 50/50.. its just that the ones that piss you off are much easier to remember, you dont remember the ones that gove you directions, or get the keys out of the car, etc....

the might have violated your rights, but in all honesty, is this exactly how it happened?

If you or your vehicle matched the desription given of some kids vandalizing houses, than the *might be able to search you and your car (i dont know waht the state/city statutes of your area are).. around here, of someone said that they just had their house burlarized, and said it was you, the police can search you (clothes on) on site for any valuables, etc, if the person is willing to file a complaint than the police can attempt to determine if you were involved

then every detail about your vehicle is engraved in their mind, and when they see you again, they wait for you to do anything, no matter how minute, to phuck with you again. and again, and again. ive never been in the situation, and most cops around here are cool (atleast the ones ive run into), but no one around here has a truck like mine, and everyone knows me.

and its what i would do if i was one of the cops and a kid i harassed tried to phuck me back. id arrest ya, making sure ya didnt see me (or having my partner vouch i was with them at that point in time) make sure it wasnt on film, rough ya up alittle bit, drive ya 100 miles away in the middle of the woods somewhere and leave ya. aint makin my *** ride a bike around town or be captains ***** for a week and gettin away with it. but thats just me.
