Issue with my apt complex management.

So they told you that they have the right to implement any price they want? and that you have to give notice to not renew the lease? did they even send you a renewal form? usually when its on month to month then its only 30 day notice from my understanding and 60 day when under a contract

But seriously they should have told you when you moved in that you had to give 60 days notice.
Well they should but legally they are not liable since they put that in the contract that he signed. From my experience when a person/company tries to rush you to sign a contract or dont mention to you that you may want to read the contract first then you should be wary about it, b/c once you sign, there goes your legal rights to dispute the contract, and that is with everything

 
wouldnt it have been her job as an apartment manager when there was 60 days left on your lease she informed you of the "60 notice" and i know here that a 30 day notice is needed via the landlord to kick you out, but i have never heard of having to stay 60 after your legal lease has ended.

Claim to have been under the influence of drugs and alcohol when you signed the lease and state that you werent notified about this until your legal contract was up. i would refuse to pay. i mean whats the point of having a lease if they can make rules as they see fit.

yeah one of the lawyers said maybe u can get away with 30 but then he said if its 60 day then its 60days.

his exact words were " you're screwed, buddy."

indeed, one of the lawyers confirmed its common Texas Lease Contract.

he said once u don't renewe it goes month to month and they Can charge whtever they want.

he said if im tellin u this and if shes tellin u this then go figure.

 
Sorry we couldn't help, im just glad that im now my landlord, b/c these complex's are croooooooked.

P.S. make sure there is no damage at all to the carpet b/c they will charge you around $1 sq ft to recarpet the whole thing after leaving even though they were going to do it anyway. So for ex. if you apt is 900sq ft expect a $900+ bill even if its very minor damage

i would get my own house but my job requires bunch o travelling with 3 months to 2 year assginments.

right now travelling for month and a half then in 6 months travelling for year and half. Then who knows.

im sure there will be some fees. one thing i gotta do change all the bulbs.

they charge $5 for a regular bulb and bathroom and living room has tons of them and not regular ones.

They did send me bunch of crap including calendars flyers about their yoga,bootcamp, and kickboxing classes. and bunch of other stuff. I would skip through them really fast and trash em. So i cant really tell u if there was a notice or not. They send so much crap you start to think it's all garbage.

I personally thought if there's any notice it should apply if you want to renew only.

dont take it to an attorney, they'll charge you out of the *** even if the consultation is free. What you need to do is find that fine print about the 60 days notice. if it exist then there is not much you can do but a legit business don't do that. Once your contract is over with, its on a month to month lease and its up to you if you want to extend it or not. Second of all, it is illegal for them to charge you whatever they want once your lease is up. They can state in the contract that once your lease is up and decide that you want to extend your contract then they have the right to increase the rent by a certain percent. I don't think it can exceed 10% w/o proper cause.

Its kinda like you're with tmobile with a 2 year contract. Once your contract is up, its up to you if you want to renew your contract or be on a month to month and they don't charge you whatever they want when you're on a month to month contract either.
